This study is to confirm the concept of the existing diversion by observing the existence of restorative justice which is simple condition of diversion. The restorative justice is rather to be a premise of diversion but performs independent function. Its ultimate goal is almost same as that of diversion. Ultimately, to include the restorative justice, which cannot be accepted as a concept of the existing diversion, into the concept of diversion,reconceptualization would be necessary. Such reconceptualization would be needed to define the scope of not only new diversion which will emerge later but also restorative justice. Through reconceptualization of diversion, it is suggested to use as "Consignment Type Diversion" because of conceptual confusion of the existing intervention diversion and emergence of new diversion.
