국외 성범죄 및 성착취 방지를 위한 국제공조수사체계 개선에 대한 연구 - 국제형사경찰기구(인터폴) 출국통보제도를 중심으로 -

초록

본 연구는 성범죄에 대한 기존의 심리학적·교정학적 연구에 더해 성범죄의 국제성이라는 범죄학적 특성을 중심으로 연구를 수행하여, 국제성의 핵심구성요소로 국가간 ‘이동’을 특정하고, 이러한 ‘이동’에 대응하기 국제공조 방안을 도출하는 것을 본 연구의 목적으로 하였다. 특히, 국내·외의 법적·제도적 사항들을 검토하여 성범죄의 국제적 이동에 대한 접근 가능한 대책이자, 국내에 도입되지 아니한 국제형사경찰기구(인터폴)를 통한 출국통보제도의 특성 및 이를 가능하게 하는 해외의 입법례를 검토하였다. 그리고 이러한 검토내용을 바탕으로 국내에 해당 제도를 적용하기 위한 연구모델로, 데이터생성 근거, 통보의 내용 및 절차, 통보수단 3단계의 구성요소를 구축하여 출국통보 관련 국제공조체계 개선 모델을 제안하였다. 이를 통해 본 연구에서는 성범죄의 국제성이라는 범죄학적 관점에서 실천적 대응모델의 도출까지 이끌었지만, 해당 제도를 통해 발생 가능한 문제적 쟁점에 대한 법학적인 측면에서의 후속연구의 필요성은 한계로 남았다.

Abstract

This research builds on existing works in psychology and correctional studies on sex crimes, by identifying transnational movement as a criminological peculiarity and proposing a solution thereto. Particularly, this research reviews legal and policy frameworks, both domestic and foreign, with a view to trailblazing a traveling sex offender notification model in Korea. The said policy model is comprised of three key elements, namely, data creation, notification substance and procedure and means of notification. Whereas this research was able to outline a practical response model to the transnational dimension of sex crime, further research will need to address potential legal issues which may emerge from the implementation of this model.
