비임금노동자 실업보장체제 비교사례분석: 핀란드, 스페인, 독일, 한국을 중심으로

본 연구는 임금노동자와 비임금노동자 간의 격차 뿐만 아니라 비임금노동자 내의 격차에 주목하여, 한국 비임금노동자 실업보장체제에 대한 제도적 함의를 국가 간 비교사례 분석을 통해 논의하고자 한다. 이를 위해 먼저 탈산업화 이후 주요 복지국가 실업보장체제의 변화, 주요 복지체제의 노동시장 및 사회보장에서 비임금노동자가 경험하는 격차, 그리고 한국 비임금노동자의 노동시장 및 실업보장 경험에 관한 기존 논의를 검토하였다. 다음으로 국가 간 비교 분석을 위해 한국과 유사한 다층형 실업보장체제 구조를 갖고 있지만 주요한 실업자 소득보장 제도라고 할 수 있는 실업보험제도 유형에서 질적으로 구분되는 핀란드, 스페인, 독일을 분석 사례 국가로 선정하였다. 나아가 각 국가별 실업보장제도를 법적 대상, 적용 조건, 급여, 재정, 전달체계 차원에서 검토하고, 실업보장체제의 관계적･구조적 측면에 주목하여 국가 간 그리고 국가 내 비교 분석을 진행하였다. 이와 같은 국가별 사례 분석 결과를 바탕으로 3개 국가의 사례가 한국의 비임금노동자 실업보장체제에 제시하는 제도적 함의를 논의하였다. 우선 자영업자 고용보험(UI)에 관해, 법적 대상의 보편성 및 급여기간의 관대성, 재정적 지속 가능성, 노동형태의 다변화에 대응하는 적용 및 급여의 포괄성의 측면에서 정책적 함의를 논의하고자 한다. 다음으로 국민취업지원제도(UA)에 대해, 법적 대상의 보편성 확대, 자격조건의 엄격성 완화, 급여의 관대성 강화, 재정에서 공적 지출의 확대를 위해 필요한 제도적 변화를 제시하였다. 마지막으로, 실업보험(UI)와 실업부조(UA) 간의 관계와 관련하여. UI와 UA 간의 연계 강화, 취업 및 실업 병행 수준 강화, 비임금노동자 실업보장체제 전반의 보장성 강화의 필요성에 대해 논의한다.
Abstract
This study focuses on the gap between employees and self-employed as well as the gap within self-employed, and discusses the institutional implications of the Korean unemployment protection system (hereafter UPS) for self-employed, through comparative case analysis. First, I reviewed the existing discussions on the changes in the UPS after deindustrialisation, the gaps of self-employed in the labour market and the social security system, and the experiences of self-employed in the labour market and the UPS in Korea. Next, for comparative case analysis, Finland, Spain, and Germany, which have the multi-pillar UPS similar to Korea, but are qualitatively classified in the different type of unemployment insurance system were selected as case countries. Furthermore, the UPS for each country was reviewed regard to formal and effective coverage, benefits, financing, and administrative systems, and comparative analysis was conducted by paying attention to the relational and structural aspects of the UPS. Based on the results of such case analysis by country, the institutional implications of the three case countries to the UPS for self-employed in Korea were discussed. First of all, regarding the Employment Insurance (UI) for self-employed, policy implications will be discussed in terms of universality of formal coverage, generosity of benefit periods, financial sustainability, and effective coverage in response to diversification of labor types. Next, for the National Employment Support System (UA), institutional changes necessary to expand the universality of formal coverage, ease the strictness of qualification conditions, strengthen the generosity of benefits, and expand public expenditure in finance were presented. Finally, regarding the relationship between UI and UA. the necessity of strengthening the linkage between UI and UA, the coverage of part-time unemployment benefits, and the overall guarantee of UPS for self-employed is discussed.
