지방의회 내 독자적 입법지원기구 설립과 운영 연구: 미국 대도시 사례를 중심으로

본 논문은 지방의회 역량 강화 방안으로서 독립적 입법지원기구의 설치에 초점을 맞춘다. 한국과 같이 기관대립형 권력구조를 가진 국가 가운데 독립적 입법지원기구를 설립하고 운영한 경험이 있는 미국 대도시 지방의회 사례(로스앤젤레스시, 샌디에이고시)를분석한다. 의회 내 독자적 입법지원기구 설립과정은 물론 이들이 어떻게 성공적으로 운영될 수 있었는지 제도적 요인(의원의 임기 제한, 입법지원기구 책임자의 장기근속)과 비제도적 요인으로 나누어 분석한다. 또한, 설립 실패 사례(시카고시)를 통해 입법지원기구설립을 위해서 어떠한 조건이 충족되어야 하는지를 인구 대비 의원 수 비율, 의원의 임기제한 등에 초점을 맞추어 분석한다. 이러한 미국 대도시 사례 분석은 한국 지방의회 내독자적 입법지원기구 설립 주장이 힘을 얻기 위해서는 현행 의원 수를 재조정하는 것이선행되어야 하고, 대규모 조직보다는 소규모 조직으로 우선 시작하며, 지방의회 재정 상황에 따라 회계 및 입법 분석 법인과 합작하는 방식도 고려해볼 수 있다는 함의를 준다.
Abstract
This paper focuses on the establishment of an independent legislativesupport organization in local councils as a way to strengthen the capacityof the councils. It analyzes the cases of US metropolitan district councils(Los Angeles City, and San Diego City) with successful experience inestablishing and operating an independent legislative supportorganization by using institutional factors (term limits, long-term serviceof the legislative support bodies) and non-institutional factors. Besides,through the case of failing to establish an independent legislative supportorganization (Chicago City), this paper analyzes the conditions to be metfor the establishment of the organization. It reviews the ratio of thenumber of members to the population and the term limit of members. This case analysis of large cities in the US tells us that the local council'scurrent size should be readjusted to establish an independent legislativesupport organization in the Korean local councils. The results also impliesthat middle-sized local councils can consider a way to collaborate witha publicly trusted accounting and legislative consulting firm like SanFrancisco City-County.
