민주화 시대의 정보기관은 효율적인 해외정보활동과 얼핏 보기에 양립하기 어려운 윤리성의 요구를 어떻게 인식하고, 수용해야 하는가 하는 어려운 문제에 직면하게 되었다. 이 연구는 정의의 전쟁 이론을 활용하여 해외정보활동 자체의 정당성과 해외정보활동 행위의 정당성이라는 두 차원에서 윤리성의 틀을 제시하고 특히 비밀활동들을 중심으로 윤리성의 적용을 검토하였다. 또한 해외정보활동의 윤리성 확보는 정보관의 사기와 정보기관의 인기를 증가시킴으로써 정보활동 환경을 개선시키고 이는 장기적으로 해외정보활동의 효율성에도 긍정적인 효과를 갖는다고 주장한다. 그리고 그러한 윤리성의 확보를 위해 정보활동 윤리지침의 작성과 공개의 필요성을 권유하였다.
Abstract
In the age of democratization, intelligent agency is obliged to face awkward ethical questions which are incompatible with the effective practice of intelligence at a glance. This paper suggests a framework for ethics of intelligence activities at two levels of jus ad intelligentiam and jus in intelligentia on the analogy of ‘just war’ theory, and examine its application to clandestine operations in particular. I argue that to strengthen ethics of intelligence would raise the morale of intelligence officers and increase the agency’s popularity from the people, which would be followed by enhancing the environment of intelligence activities. It means that the emphasis on intelligence ethics has positive impacts upon effective intelligence. In addition, composition of an unclassified ethics code for intelligence officers is recommended to secure and reinforce intelligence ethics.
