국내 정보활동과 기본권: 미국의 사례를 통해 본 교훈

초록

감청과 같은 국내 정보활동은 국가 안보와 이익을 보호하는데 있어서 매우 중요한 역할을 수행한다. 그러나 이러한 활동은 시민들을 대상으로 할 수 있기 때문에 기본권 침해와 관련된 공적 비판의 대상이 되고는 한다. 본 논문은 국내 정보활동 및 기본권과 관련된 주된 논쟁들을 분석하고, 미국의 사례를 인용해 가며 한국에서 국내 정보활동과 관련되어 제기되었던 문제들의 성격을 진단한다. 이를 바탕으로 한국에서의 국내 정보활동의 정통성과 그에 대한 시민들의 태도를 향상시키고, 국내 정보활동이 기본권 침해와 관련된 논쟁에 휘말리지 않고 본래의 순수한 목적에 충실하기 위해 이루어져야 할 점들을 논의하는 것을 목적으로 하고 있다.

Abstract

Domestic intelligence like wiretapping can play a very important role in protecting national security and interests. However it can target citizens and thus, it could violate civil liberties. For this reason, domestic intelligence often becomes the focus of public censure. This paper identifies major controversies over domestic intelligence and diagnoses the characteristics of the questions brought up with regard to domestic intelligence in South Korea, and referring to American cases, discusses what should be done to improve the legitimacy of domestic intelligence and citizens' attitude towards domestic intelligence in South Korea. This paper proposes several ways in which domestic intelligence can be improved so that it, without being interrupted by the disputes about its violation of civil liberties, can serve its genuine purposes.
