Abstract
This paper aims to analyze the background and process of the adoption of Lex Maritima (Tokyo Principles of Maritime Law), officially adopted by the Comité Maritime International(CMI) in 2025, as well as the normative foundations underlying the formation of uniform maritime law principles. The study sheds light on the development of Lex Maritima by addressing gaps in international maritime law through empirical and comparative legal analysis, drawing on domestic legislation, case law, practices, and scholarly writings from various jurisdictions. It demonstrates that the Lex Maritima initiative was not intended as a single international convention or model law, but rather as a ‘historical consolidation’ of common principles. The paper also provides a detailed account of the adoption and organization process of the three types of principles (norm-based, substantive, and practice-based) that are effectively applied in the international community. Furthermore, it examines the soft law nature of Lex Maritima, its limitations in binding force, and its implications for the development of maritime law in relevant countries and regions. In conclusion, the study suggests that CMI’s efforts to unify international maritime law enhance predictability and legal certainty in shipping and maritime dispute resolution, while highlighting the need for proactive participation and an expanded role of the Korean and broader Asian maritime law community.
