영국에서 사회적 가치의 실현은 일반 대중들의 사회운동에서 출발한 것이지만, 이제는 정부도 다양한 관심을 가진다. 따라서 영국에서는 사회적 가치의 개념이 매우 다양하게 변화/발전하고 있으며, 관련 법의 출현은 이러한 상황을 잘 반영한다. 다양한 기업모델이 사회의 전통적인 사회적기업모델에 적용되거나 변화를 가져올 때, 정부의 지원이나 일반 기업과의 차이를 어떻게 처리할 것인가는 여전히 숙제이다. 한국은 2007년 사회적기업육성법을 제정하여, 사회적기업을 국가가 지원하는 법제적 틀을 마련하였다. 아울러 협동조합 형태의 사회적기업에 대한 지원체계도 갖추어가고 있다. 이러한 영국의 모델은 미국식 모델보다는 공공성이 강조되는 유럽형 개념과 유사하다. 기업제도에 관하여 오랜 역사를 자랑하는 영국의 법제도는 한국형 사회적기업의 발견 또는 사회적 가치의 추구에 대한 규율에 있어서 다양한 시사점을 제공한다.부의 중재적 역할을 기대할 수 있다.
Abstract
The realization of social values in the UK began with the general mass movement, but in the modern economic society, the government is also interested in the activities of social enterprises. In the UK, the concept of social enterprise and social values is changing/developing in a wide variety, and the emergence of relevant laws reflects this situation well. When various business models are applied to the traditional social business model of society or bring about change, how to deal with the difference from government support or general business is still a task. Korea enacted the Social Enterprise Promotion Act in 2007 and established a legal framework to support social enterprises at the government level. In addition, a support system for social enterprises in the form of cooperatives is in place. This model is similar to the European concept that emphasizes publicity rather than the American social enterprise concept. The UK legal system and model, which has a long history of corporate systems, offers a variety of implications for the discovery of the Korean social enterprise model or the discipline of the pursuit of social values.
