Abstract

The change of the grounds for an administrative disposition refers to a situation where the administrative agency, after rendering a disposition, later presents a ground that was not originally indicated at the time of the disposition. This mainly occurs when the agency determines that the original ground alone may not be sufficient to justify the legality of the disposition, and therefore asserts a new ground during administrative litigation. In this respect, the issue of changing the grounds for disposition is fundamentally a matter of substantive law related to the legality of the disposition, but it is also an issue of procedural law involving matters such as the subject matter of the litigation and the scope of judicial review. Furthermore, it is also related to the need to strike an appropriate balance between the competing ideals of administrative litigation-namely, the protection of the right to defense and the one-time resolution of dispute. For the past 40 years, the Korean Supreme Court has addressed the issue of changing the grounds for disposition based on the so-called “identity of fundamental facts” doctrine. This doctrine appears to have been influenced by criminal procedure principles that limit changes to indictments and define the scope of judicial review. Given that this doctrine originated in the more stringent context of criminal litigation-which can have more severe impacts on a citizen's life, body, and property-it seems to have been adopted into administrative litigation without much criticism. In fact, it has often led to substantively reasonable conclusions in individual cases, and from that perspective, it would have been difficult to devise an alternative legal doctrine superior to the identity of fundamental facts. However, today, the content of administrative dispositions has become increasingly complex and multifaceted, and administrative disputes have grown both in quantity and in complexity. As such, relying on a single doctrine-the identity of fundamental facts-to derive appropriate conclusions in all cases has become increasingly difficult. Over the past 40 years, as the Korean Supreme Court precedents have accumulated, some cases give the appearance of mutual inconsistency or contradiction within this doctrine. Given this situation, there is a need to carefully reassess the identity of fundamental facts doctrine in its entirety and reconsider the issue of changing the grounds for administrative disposition Although the identity of fundamental facts doctrine has generally led to substantively reasonable conclusions in individual cases where the issue of changing the grounds for administrative disposition was raised, the inconsistency found in cases where only the legal basis of the administrative disposition changed has placed a significant burden on the lower courts. The scope of changing grounds for disposition may not be limited solely to changes in facts but should also include changes in the legal basis. However, whether such change should be permitted must be assessed from a separate perspective. From this standpoint, the position presented by the Korean Supreme Court in its 28 November 2024 Judgement (Case No. 2023Du61349) is meaningful. Nevertheless, since the Court did not explicitly declare a change in precedent, further careful examination is needed in the future.
