국가관할권이원지역의 해양보호구역에 관한 고찰- OSPAR협약을 중심으로 -

해양보호구역제도는 해양생명체, 서식지, 특정 지역의 생태계를 통합적인 방식으로 보호하는 제도이다. 바다의 헌법이라고 불리는 유엔해양법협약(협약)은 명문의 규정은 없지만 해양환경을 보전하기 위하여 해양보호구역과 같은 지역기반 관리조치를 취할 수 있는 근거가 된다고 여겨진다. 그런데 공해와 심해저와 같은 국가관할권 이원지역에 해양보호구역을 설정하고 관리할 수 있느냐 하는 의문은 있다. 본 논문에서는 국가관할권 이원지역 특히 공해해양보호구역제도를 검토하는데, 특히 OSPAR 협약 체제에서 운영되고 있는 공해해양보호구역을 분석하여 국제적인 제도의 문제점과 발전 방향을 제시한다. 일반적인 해양보호의무와 공해 자유에 대한 제한의 일환으로 국가관할권 이원지역에도 해양보호구역을 설정하고 해양활동을 규제할 수 있는데, 대체로 지역차원의 국제기구의 역할이 중요하다. 2010년에 OSPAR는 공해 지역에 6개 해양보호구역을 설정하였다. 그런데 OSPAR 공해해양보호구역은 법적 근거, 비체약국에 대한 적용 가능성 그리고 규제조치의 실행 등과 관련한 문제점이 있다. 그리하여 국가관할권 이원수역에서 해양환경을 보호하기 위해서는 모든 관련 국가들이 환경기준의 설정과 이행조치에 협력할 필요가 있다고 하겠다. 해양보호구역제도는 일반적으로 어업과 항해 문제에 대해서는 다루고 있지 않는다. 그리하여 이 분야의 관련 기관들과의 협력과 조정이 필요하다. OSPAR 공해 해양보호구역의 경우에는 북동대서양어업위원회(NEAFC)와의 협력관계가 보다 더 통합적인 방법으로 이 지역 해양환경을 보호하는데 유용하게 작용하고 있다. 공해 해양환경보호에 있어 OSPAR의 성과에도 불구하고, 국가관할권 이원지역을 보호하기 위한 구체적인 법제 마련은 필요하다고 본다. 유엔해양법협약을 개정하여 구체적인 근거 규정을 마련하든지 새로운 범세계적인 협정을 제정할 것이 요구되는데, 국가들간의 다양한 이해관계로 인해 합의도출이 쉽지는 않을 것으로 보인다. 이 경우에는 유엔을 통한 공해 해양환경보호구역의 설정과 관리도 하나의 방안이 될 수 있을 것이다. 보다 근본적으로는 공해해양환경보호구역의 설정을 뒷받침할 수 있는 확실한 과학적 근거를 마련하여야 한다. 그리고 그 설정에 이해관계자 모두의 참여가 보장된 제도가 마련되어야 하고, 관련 국제기구들과의 협력관계를 유지하는 것도 공해 해양보호구역의 성공을 위해 필요할 것으로 보인다.
Abstract
Marine Protected Areas(MPAs) are one of the means to protect and conserve the marine environment. The rights and responsibilities of nations with respect to their use of the world's oceans are defined in the United Nations Convention on the Law of the Sea(UNCLOS). UNCLOS does not provide the specific terms of MPA networks. However, its extensive environmental obligations provide a strong legal basis to establish area-based management measures including MPAs. There are some problems to establish MPAs in areas beyond the limits of national jurisdiction(ABNJ). As there is no centralized organ governing the high seas, it seems realistic that conservation of specific parts of the high seas should be undertaken by regional international institutions and arrangements. In 2010, the Contracting Parties to the Convention for the Protection of the Marine Environment of the North-East Atlantic(OSPAR Convention) created six MPAs on the high seas. The creation of MPAs on the high seas raises several legal issues concerning its legal ground, opposability to non-Contracting Parties, practical implementation and so on. For the protection of marine environment in ABNJ, it is required for all States involved agree upon environmental standards and cooperate with respect to the implementation measures. MPAs to protect the marine environment cannot, on their own, regulate fisheries and marine transportation. Thus there is a need to promote positive co-operation and co-ordination between relevant international organizations. In the case of the OSPAR MPAs on the high seas, the inter-linkage between the OSPAR and NEAFC is useful to protect the marine environment in a more integrated manner.
