한국 전통지식의 보호 방안에 대한 소고

본 논문은 한국의 전통지식의 보호 방안에 대한 것이다. 전통지식의 보호를 위해서, 전통지식 보유하고 있는 집단이 권리능력이 있는 단체를 구성하여 현재의 지식재산권 체계를 통하여서도 보호할 때 전통지식의 보호가 확대될 수 있다. 전통지식을 보유하고 있는 집단이 단체를 구성하여 특허권, 디자인권, 상표권, 저작권 및 영업비밀에 대한 권리를 보유할 수 있게 된다면 이를 활용하여 보다 효율적으로 전통지식을 보호하는데 활용할 수 있을 것이다. 전통지식 보유 단체가 저작권을 확보할 수 있다면 저작재산권에 의한 전통지식의 보호뿐만이 아니라 저작인격권을 통하여 자신의 전통이 오용되어서 평판을 떨어지게 되는 일을 금지 또는 예방할 수 있다. 또한 단체가 존속하는 한 저작인격권은 현재 저작재산권의 존속기간과 같이 보호기간이 종료되지 않으므로 반영구적으로 보호될 수 있다. 한국의 전통지식이 보호되기 위해서는 전통지식 보유자로 이루어진 단체의 구성이 필요해 보인다. 그리고 이 단체를 통해서 스스로가 자신의 전통지식 보호를 위해서 노력을 해야 할 것이다. 이렇게 할 때 한국의 장류, 전통주 및 막걸리, 인삼가공기술, 김치제조기술, 한식문화, 구전민담 이야기 소재, 전통문양, 및 한의학 정보지식은 한국의 특유의 전통지식이 보호될 수 있다고 본다. 국가는 이와 같은 단체의 설립을 적극 지원하고, 아직 지식재산권의 인식이 부족한 전통지식에 관한 권리를 보유한 단체의 보호를 위해서 사전통보승인(prior informed consent: PIC) 및 상호합의조건(mutually agreed terms: MAT)을 통한 이익공유시스템(ABS) 도입을 통하여 주체적으로 활동하지 않는 단체의 전통지식의 소극적 보호에 도움을 주는 촉진자적 또는 보조자의 역할을 우선적으로 수행하고, 적절한 단체가 설립되기 전 또는 없는 경우에는 직접 권리주체로서 역할을 해 주는 것이 바람직해 보인다.
Abstract
This paper focuses on the protection of traditional knowledge in Korea. For broadening the protection of Korean Traditional Knowledge (TK), it is better to constitute a collective entity having capacity of enjoyment of rights and protect its rights with the existing intellectual property system. If a collective entity could own patent rights, trade mark rights, copyrights, and trade secret rights by constituting the collective body having capacity of enjoyment of rights, they can effectively protect their Traditional Knowledge with these rights. If a collective entity having traditional knowledge have copyright, the collective entity could use copyright property right and moral right for protection of their traditional heritage from misuse of their traditional knowledge and prevent from the deterioration of their reputation. The protection period of moral rights would be semi-permanent as long as the collective entity may exist, which is accorded with the system of protection period of current copyright law. In order to protect Korean traditional knowledge, it is necessary to construct a collective entity of traditional knowledge holders. Also, this collective entity needs to try to protect their traditional knowledge by themselves. In doing so, Korea's unique traditional knowledge such as Korea's soybean soup, traditional wine and makgeolli, ginseng processing technology, kimchi manufacturing technology, Korean traditional food, Korean folk tales, traditional Korean patterns and traditional Korean oriental medical information will be protected well. It seems desirable for Korean government to actively support the establishment of such collective entity and to play a facilitating role to help a collective entity by establishing Access and Benefit Sharing (ABS) system with Prior Informed Consent (PIC) and Mutually Agreed Terms (MAT). In the case that there is no or before establishment of such collective entity, it is preferable that Government works as a collective entity having capacity of enjoyment of rights.
