민속의 보호에 관한 검토

초록

민속이 보호되어야 하는지, 민속을 보호된다면 민속의 어떤 부분이 보호될 것인지, 기존의 규정들 또는 지적재산권법에 의하여 민속이 보호될 수 있는지, 민속 보호의 이익을 어떻게 분배할 것인지 누구에게 분재의 이익이 돌아갈 것인지 등의 문제가 제기된다. 민속과 관련한 쟁점들을 해결하기 위하여 국제적, 지역적 및 국가적 차원의 논의가 진행되어오고 있으며 일부 국가들은 다양한 법에 의하여 민속을 보호하고 있다. 민속을 보호하기 위한 법리로서, 저작권법, 상표법, 부정경쟁방지법, 디자인보호법, 관습법 및 지적재산권법 이외의 보호를 고려할 수 있으나 기존의 법을 통해 민속을 보호하는 데에는 한계가 있다. 민속을 보호하기 위해서는, 먼저 민속의 정의 및 보호받은 수 있는 민속의 범위가 명확하게 정립되어야 하고, 민속을 보호하기 위한 독자적인 보호법이 필요할 것으로 보인다. 또한 민속을 보유한 공동체 일원들 간의 권리문제와 유사 민속을 보유한 여러 공동체간의 권리 처리 문제가 해결되어야 할 것으로 보인다.

Abstract

The issues regarding folklore are whether folklore should be protected, what is protected if folklore should be protected, whether folklore can be protected by the existing rules or intellectual property laws, how the benefits can be distributed and who are the beneficiaries from the benefits. In order to resolve the issues, international, regional, and national rules have been discussed and some countries are protecting folklore with various kinds of laws. As the legal principles to protect folklore now, copyright and neighboring rights, trademark laws, antitrust laws, design laws, customary laws and other rules except intellectual property laws can be considered. However, the existing rules are not always proper and enough to protect folklore. Therefore, first of all, the definition of folklore should be established, and a sui generis is necessary to protect folklore. Also, the issues regarding the rights between the members of the issued community in which folklore was transmitted and the rights between the communities which have similar folklore should be resolved.
