한국 극영화에 나타난 표절과 모방에 관한 고찰 - <오! 브라더스>와 <레인맨>을 중심으로-

Abstract

The present study purposed to propose a fundamental method for Korean film dramas to imitate various genres of foreign movies in creative ways without being embroiled in disputes over plagiarism. For this purpose, we compared <Oh Brothers> with <Rain Man> focused on general structure, the composition of characters, the utilization of properties, etc. based on the concepts of plagiarism and imitation. Through comparative analysis such as pattern test, we found that the two films share intrinsic similarities and <Oh Brothers> has several problems in its characters and its utilization of properties resulting from the unreasonable disintegration of contents, which could not be disintegrated, in the process of imitating <Rain Man>. The practice of plagiarizing foreign movies observed frequently in Korean movies has many problems in that it imitates not ideas or plots but expressions with intrinsic similarities, which must be protected. Considering that plagiarism is determined based on intrinsic similarities rather than on extrinsic appearances, the practice of plagiarism prevalent in Korean movies will hinder the development of our movie industry and deteriorate the quality of Korean movies in the long run.
