Abstract

The Supreme Court of Canada(hereinafter “SCC”) is the court of last resort. It holds appellate jurisdiction and reference jurisdiction. The reference jurisdiction of SCC is stipulated in the Supreme Court Act which gives the governor-in-council the ability to submit reference questions regarding the constitutionality of federal and provincial legislation, interpretation of the Constitution, and other important questions of law, etc. Critics assets that this reference jurisdiction of the SCC violates separations of powers, independence of the judiciary, and that it raises ethical issues. Nevertheless, many controversial sociopolitical issues, federalism issues and charter right issues were decided through the reference jurisdiction, Flagship cases include the Quebec seccession reference, same-sex marriage reference, genetic information reference, carbon tax reference. Along the course, the SCC has been seen as an arbiter between governments and guardian of the Constitution. Scholars in Europe and the United States have taken interest in SCC’s reference jurisdiction. This reference mechanism allows the government to receive authoritative advisory opinion from the SCC even without actual litigants and concrete case presented, resolving disputes at early stages and thus lessening the social cost while upholding the fundamental rights of individuals. The Constitutional Court of Korea engages itself in a posteriori concrete norm review, while the SCC engages itself in abstract norm review via reference jurisdiction. Korea needs to sincerely consider the possibility of adopting abstract norm review in its system through Constitutional amendment so that it can resolve political and social conflict at early stages, pursue legal stability, and strengthen fundamental rights of individuals. If we limit the parties eligible to submit abstract norm review(President, government, and minority political party, etc), and only allow submissions which raise reasonable suspicion regarding the legality of a legislation or a bill that relate to important constitutional questions, then we can solve the problems of frivolous lawsuits being raised and resolve contentious issues at early dates.
