1980년 삼청계획 제5호에 따른 신군부의 억압적 조치들은 이른바 ‘사회 하위계층’에 대한 전쟁이었다. 1988년 이후 삼청교육피해자들을 위한 피해 신고절차가 네 차례 마련되었으나 피해자 중 1할만이 절차에 응했다. 이처럼 저조한 신고율은 삼청교육사건의 성격 및 삼청교육피해자의 특성과 밀접하게 관련된다. 삼청교육사건에는 사회적 편견과 국가폭력이 심층적으로 교차 작용하였기 때문에 국가에 의한 피해배상만으로는 풀기 어려운 암류가 존재한다. 피해자들의 의식 속 깊은 어둠을 극복하기 위해서는 특단의 사회문화적 기획이 필수적이라 여겨진다. 피해자의 운동도 대국가적인 인권 투쟁을 넘어 공동체의 성원으로서 인정투쟁으로, 자기신뢰의 회복운동으로 확장되어야 한다. 이 글은 1988년부터 2024년까지 삼청교육사건에서 이행기 정의의 전진과정과 피해자들의 투쟁사를 세 단계로 논의한다. 제1국면(1988-1999)은 민주화 이후 국회에 설치된 5공비리조사특별위원회의 청문회를 배경으로 벌어진 피해자들의 인정투쟁과 좌절을 다루고, 제2국면(2000-2019)은 한국사회에서 일어난 이행기 정의의 거대한 흐름 속에서 삼청교육피해자법의 시행과 배제된 피해자들의 고단한 투쟁을 추적하고, 제3국면은 진실화해위원회의 2022년 진실규명결정과 그 이후 이행기 정의의 재점화를 검토하고, 마지막 장은 삼청교육피해자법의 개정방향을 제안한다.
Abstract
The repressive measures taken by the new military group under Samcheong Plan No. 5 of 1980 were a war against the lower classes. There were four times damage reporting procedure for the Samcheong victims since 1988, but only 10% of the total number of victims responded to the procedure. This low reporting rate is closely related to the characteristics of the Samcheong Incident and its victims. Since social prejudice and state violence operated deeply in the Samcheong Incident, there are the undercurrents that are difficult to resolve through state compensation alone. The special social and cultural projects are essential to overcome the deep darkness of victims’ consciousness. The victims’ movement should also expand from rights struggle against the state to struggle for social recognition and movement for restoration of self-esteem. This article discusses the history of transitional justice and struggles of the Samcheong victims from 1988 to 2024 in three epochs. The first phase(1988-1999) focuses on the struggles of victims for recognition and their frustration against the backdrop of hearings of National Assembly Special Commission for Investigating Wrongdoings under the Fifth Republic. The second phase(2000-2019) deals with the Samcheong Victims Act and the ardous struggle of those still excluded amid the great wave of transitional justice in Korea. The third phase reviews the rekindling of the transitional justice after the 2022 decision by the Truth and Reconciliation Committee. The concluding chapter proposes the direction of revision of the Samcheong Victims Act.
