사회 헌법론: 국가-정치 헌법에서 초국가적 사회 헌법으로

Societal Constitution: From State-Political Constitution to Transnational Societal Constitution

초록

헌법 사회학은 국가 영역에서뿐만 아니라 사회 영역에서도 헌법이 발생하고 있다는 사실에 주목한다. 근대 정치 헌법이 전제 군주제와 독재에 대항하는 규범적 틀이었다면, 오늘날 사회 헌법은 사회적 권력에 대한 투쟁을 고민하는 과정에서 만들어지고 있다. 국가 권력은 자신이 존재하는 정치 공동체와 주변 사회 영역을 전체주의화하는 경향을 보였고, 정치 헌법은 이러한 경향을 제어하는 과정에서 진화하였다. 이와 유사하게, 오늘날 기능적으로 분화되어 자율성을 확대하는 기능적 부분 사회 체계들은 국가의 통제를 넘어서 주변의 다른 체계를 자신의 부분적 합리성 아래에 획일화하려는 경향을 보인다. 토이브너는 점증하는 사회적 권위주의를 사회의 부분적 합리성이 과도하게 커져서 다른 영역의 합리성을 억압하는 병리 현상으로 본다. 오늘날 적폐로 명명되는 다양한 사회적 병폐들의 원인은 국가 권위주의보다는 사회적 권위주의에서 찾을 수 있는 경우가 많다. 과거 한국 헌법학이 독재 권력 밑에서 신음하면서도 진정한 헌법을 찾으려고 했던 것처럼, 오늘날 헌법학자들은 사회의 자율성이 사회 구성원을 억압하는 역설적이고 파괴적인 경향에 대항하여 사회에서 진정한 헌법을 찾기 위해 헌법 이론을 재정립하고자 한다. 이런 맥락에서 본 논문은 다원화되는 사회(체계이론에서 말하는 기능적으로 분화된 사회)에 존재하는 다양한 갈등과 충돌을 해결하는 이론적 분석 틀로서 사회 헌법 개념을 제시하고자 한다. 그리고 다원화된 사회의 갈등과 충돌이 사회의 해체 또는 그에 대한 반동으로서 사회의 획일화(통일)로 이어지지 않고 다원성의 공존에 기초한 통합으로 이어지는 원동력이 되도록 할 수 있는 대안을 모색하고자 한다.

Abstract

Constitutional sociology pays attention to the fact that the Constitution is emerging in every social sector as well as politics. While the societal constitution exists in the social sector out of the political system, it shares many key characteristics with the constitutional principles of political constitution. The power of the nation-state has tended to increase totalitarian pressure in the political communities and surrounding social domains in which it exists, and the political constitution developed in the process of taming these authoritarian threats. Similarly, today, each social system that extends autonomy through functional differentiation subordinates other neighbouring systems under its partial rationality beyond the control of the state power. Teubner considers increasing social authoritarianism as a pathology in which the partial rationality of society has grown so large that it suppresses rationality of other domains. The causes of various social maladies today called deep-rooted evils are often found in social authoritarianism rather than political authoritarianism. Just as the Korean constitutional theorists under the dictatorship in the past had tried to find a real Constitution, today constitutional scholars are searching for the constitution as a normative frame against the ironic and destructive trend of suppressing the members of society in its search. In this context, the paper proposes the concept of the societal constitution as a theoretical framework for solving conflicts arising in a pluralistic society (a functionally differentiated society as described in systems theory). Through societal constitutional theory, it is possible to integrate the conflicts a pluralistic society into the dynamics that lead to the coexistence of multiple societal rationalities rather than the uniformization of society (reunification).
