Abstract

Contemporary society, increasingly structured by digital technology, is facing various social pathologies. Digital constitutionalism has emerged as a framework to address these issues from the perspective of constitutional regulation, which can be broadly categorized into two streams: national digital constitutionalism and societal digital constitutionalism. This paper critically analyzes the characteristics and limitations of both approaches, offering a prospective alternative. I argue that the central task of digital constitutionalism is to democratically rectify the power asymmetries inherent in the digital society. This requires the imposition of constitutional regulation over institutions that exercise digital power unjustly. However, the predominant trend in contemporary digital constitutionalism overly focuses on the protection of fundamental rights and the judiciary’s role, while neglecting avenues for democratic participation. I will argue that, in order to justly uphold constitutional democratic values and order amid the challenges posed by digital technological structural transformations, constitutional regulation through the guarantee of democratic participation is essential. In this regard, I emphasize that digital constitutionalism must be understood through the lens of deliberative democracy. I will also contend that a dual rule of law, in which the democratic governance processes of both the societal constitution and the state constitution are self-reflexive and mutually interactive, will be a key factor in the establishment of democratic digital constitutionalism.
