본 연구는 국민기본권 보장을 위한 경찰수권조항을 고찰하는데 그 목적이 있다. 이와 같은 목적을 달성하기 위하여 선행연구를 중심으로 하는 질적 연구방법인 문헌연구를 중심으로 본 연구를 진행하였다. 국민기본권과 경찰수권조항에 대한 이해, 개별적․특별적․개괄적 수권조항에 대한 법적 고찰, 국민기본권 보장을 위한 경찰수권조항 발전방안 등을 검토한 구체적인 연구결과는 다음과 같다. 경찰수권조항은 개별적 수권조항, 특별적 수권조항, 개괄적 수권조항으로 구분할 수 있다. 개별적 수권조항은 경찰관직무집행법에서 이를 구체적으로 정의하고 있으며, 특별적 수권조항은 일반경찰법 외에 다수의 특별법령에 근거해 행해지고, 개괄적 수권조항은 경찰권의 발동근거를 포괄적으로 규정한다. 국민기본권 보장을 위한 경찰수권조항의 발전방안으로는 첫째, 개별적 수권조항을 보다 세분화, 엄격화하여 경찰필요에 다양하게 대처하면서도 경찰권 남용을 막고, 개괄적 수권조항도 경찰관직무집행법 내에 구체적으로 명문화함으로써 보충적 경찰권 발동의 법적 근거를 마련하여야 한다. 둘째, 모든 경찰활동은 직무규범의 범위, 즉 법률에 정해진 임무의 범위 내에서 행해져야 하는데 개별적, 특별적, 개괄적 수권조항에 근거하여야 하며 특히 적법한 경찰권 행사는 법의 내용이 정당해야 함을 전제로 한다. 셋째, 경찰권 행사에 앞서 국민기본권에 대한 근본적인 인식 제고가 필요한데 경찰이 경찰권을 행사할 경우 헌법에서 보장하고 있는 천부인권인 국민기본권을 억압․규제할 것이 아니라 적극적으로 보장․보호하도록 인식을 전환해야 할 것이다.
Abstract
Purpose of this study is investigating police delegation of legal power for nation fundamental right guarantee. Examines advanced research to achieve such purpose and progressed literature study by qualitative method of study. Specific study finding that examine is as following which comprehension for nation fundamental rights and police delegation of legal power article, legal investigation for delegation of legal power article the individual·special·general, police delegation of legal power article development plan for nation fundamental rights guarantee. Police authorization article can fall into individual authorization article, special authorization article , general authorization article. Individual authorization article is defining concretely in police officer job execution law, and special authorization article is specified to many special statute except general Police Law, and general authorization article prescribes action basis of police power comprehensively. Development plan of police authorization article for nation fundamental rights guarantee is as following. First, must cope variously on police need subdividing individual authorization article, and keep away police power abuse. Also, general authorization article stipulates expressly concretely in police officer job execution law and must ready legal basis of police power operation the supplement. Second, though all police activities should be done in extent of job rule, that is, extent of duty decided to law individual authorization article, special authorization article, general authorization article. Specially lawful police power operation presupposes that contents of law should be right. Third, need elementary realization raising about nation fundamental rights before police power operation. The police will have to change realization to guarantee actively and not something to suppress nation fundamental rights that is natural rights guaranteing in the constitution when exercise police power.
