정보사회의 유전적 프라이버시에 관한 일고찰

본 논문은 정보산업과 동반관계에 있는 생명공학산업이 가속화대중화할 것이라는 예측을 이론적 - 무어의 법칙(Moore's Law), 메트카프의 법칙(Metcalfe's Law), 유한생물학의 법칙(Limited Biological Science's Law) - 으로 제시하고, 공공기관이나 사적기관의 컴퓨터 네트워크(computer matching network)를 통한 유전자 정보의 수집이용관리상 발생할 수 있는 유전자 정보 유출에 따른 유전적 프라이버시 문제의 주요쟁점 - 생명권평등권유전자정보자기결정권 - 에 대해 고찰하고 있다.대표적인 쟁점은, 개인의 의료보장과 프라이버시 존중이라는 입장에서 유전자정보 활용을 적극적으로 반대하는 인권단체들과, 미아 찾기와 범죄예방 등 사회복지적 측면에서 공익을 위해 이용하고자 하는 국가, 민간기구, 개인 간 욕구의 균형을 어떻게 모색하느냐에 있다. 무엇보다도 사생활 보호와 공정한 유전자 정보이용의 균형을 위해 예방윤리적 측면에서 유전자 정보이용 과정에서 발생할 수 있는 문제점들에 대해 토론할 수 있는 공론의 장을 제 주체에게 제공하여 윤리적 합의를 도출하는 과정이 선행되어야 할 것이다.
Abstract
This paper describes theoretically - Moore's Law, Metcalfe's Law, and Limited Biological Science's Law - that BT(Bio Technology) industry will be popularized keeping pace with IT(Information Technology) industry. And then, examines points of issue related to gene-information outflow and genetic privacy that may occur the gathering, use and control of gene-information through computer matching network of public or private organizations. In spite of complexity of genetic privacy different from informational privacy, it is necessary that control principles should be prepared according to legal procedures in the gathering and control of gene-information so that we can solve future genetic privacy. Above all, even when the government or private organizations intend to establish DNA database banks for individual gene-information for the purpose of social welfare such as search for a missing child, the necessity and unavoidability for such works should, before establishing the law and principles, be fully discussed so that ethical agreement may be reached among members of a society.
