Abstract

Area of Freedom, Security and Justice are one of the least institutionalized policies in the EU in the way that they have relatively short history and are consisted of policies deeply related to the sovereignty of member states compared to others. AFSJ implements policies through presentation of European policy guideline and mutual recognition among member states with institutional coordination on the basis of Unity in Diversity which is the EU’s motto. Simultaneously new form of intergovernmental cooperation is proceeded based on the institutionalization of multi-level structural actors including European Commission, European Parliament and other regulatory agencies in order to cover the issues requiring a single European response. Also, the policy process of community method is applied to achieve efficiency of policy decision-making regarding the key issues. And it leaves room for opt-outs upon consideration of certain EU member states. The policy process and governance aspects for AFSJ operation is a new European Governance that combines intergovernmentalism and supranationalism newly raised in the EU since the 1990s. At the same time the objective of European integration presents that it has extended solidarity and coordination in sphere of home affairs positioned in the sovereignty of member states.
