몽골 부동산관련 법제의 동향에 관한 연구

몽골은 아시아에서 최초로 사회주의국가에서 자본주의 시장경제체제로의 전환을 1992년의 신헌법에서 선언하였다. 이를 구체적으로 실현하기 위하여 1990년대 중반에 많은 신규입법과 구법의 개정이 있었다. 그러나 시장경제 도입이 너무 급속히 이루어졌으며 외국의 기관들과 법전문가들의 조력으로 법률들이 만들어졌기 때문에 동법률들은 많은 문제점을 가지게 되었다. 특히 토지법, 삼림법, 환경법 등의 부동산 관련 법규들에게서 이러한 현상이 두드러진다. 본고에서는 몽골의 부동산관련법규들의 내용을 살펴보고 그 문제점을 검토하여 경우에 따라서는 향후 개선 과제도 제시하였다. 본고에서 연구대상으로 한 분야는 헌법과 민법의 부동산 관련 규정, 토지관련 법규로서 토지법과 토지사유화법, 환경보호관련법규로서 환경보호법과 특별보호지역법 그리고 주택법의 주요 규정들이다. 본 연구를 통해 밝혀진 것은 향후 몽골의 부동산 법제에서 가장 필요한 것은 관련 법체계들을 검토하여 법률들 사이의 정합성을 도모하고 그 효과적인 실시와 집행의 강화가 무엇보다도 절실하다는 것이다.
Abstract
The purpose of this study is to examine of the real estate-related laws in Mongolia. The study also explores disharmony of mutual relationship among the real estate-related laws in Mongolia. Mongolia is introduced a rapid process of democracy and market economic system As well as due to the land is the property of the country of Mongolian culture and their traditional way of thinking, there are many problems relating to real estate laws. The Land use-related laws, Civil law and other major environmental laws were enacted at about the same time in the middle of 1990s, in many cases with foreign assistance provided by donor agencies and international organizations such as the IBRD, ADB and UNDP. Because of these facts has resulted in a complex of legal concepts, measures and mecanisms which are ill-defined and ambiguous or alien to Mongolian tradition and regal culture, and created institutions with overlapping or conflicting jurisdictions, making it difficult to implement and enforce the provisions of the law. The fields of study in this article are the rules of Constitution and Civil Law relating to real estate, land use-related laws, Environmental Protection Laws and main provisions of Housing Act. So I believes that it is important to take careful look at the existing system of environmental and real estate-related laws as well as promote coincidence of mutual relationship among the real estate-related laws.
