Abstract

In the view of legal points, The navigation waters may be classified as territorial waters including internal waters appling the exclusive jurisdiction of the coastal State, contiguous zone, straits used for international navigation, exclusive economic zone and high seas which are open to all states, whether coastal or landlocked. Ships of all States enjoy the right of innocent passage or transit passage which shall not be impeded through the territorial sea, in the straits and in the archipelagic waters. But the coastal State may adopt laws and regulations relating to innocent or transit passage, where necessary having regard to the safety of navigation, require foreign ships exercising the right of passage to use such sea lanes and traffic separation schemes as it may designate for the regulation of the passage of ships. Ships in innocent or transit passage shall comply with generally International Regulations for Preventing Collisions at Sea and the rule of the road at sea which is adopted by the coastal State. Therefore, this paper aims to discuss the right of passage for vessel and application of the rule of the road at sea in each navigation waters.
