Abstract
Navigation is the oldest use of the sea, and it remains one of the most important. It is widely recognized that Ships of all States enjoy the right of innocent passage through the territorial seas, and all States exercise freedom of navigation in the high seas. Passage is innocent so long as it is not prejudicial to the peace, good order or security of the coastal State. The United Nations Convention on the Law of the Sea(UNCLOS) specifies activities that shall be considered not to be prejudicial to the peace, good order or security of the coastal State. UNCLOS also provides that freedom of navigation shall be exercised by all States with due regard for the interests of other States in their exercise of the freedom of the high seas. A number of States have sought to apply restrictions on vessels navigating in their territorial seas for the purpose of safeguarding their security. Measures to assert a security jurisdiction centre on a requirement of prior notification of permission of passage by foreign warships. A lot of States have also sought to regulate passage of ships carrying ultra-hazardous cargoes including nuclear materials through not only their territorial seas but also their exclusive economic zone. In addition, the Proliferation Security Initiative(PSI) have been put in force to prevent the proliferation of Weapons of Mass destruction by sea, land and air. A group of senior officials and experts suggest the “Guidelines for Navigation and Overflight in the EEZ” to clarify the rights and duties of both coastal States and user States in the EEZ. The proposed Guidelines are non-binding in nature not to create legally binding obligations between States. That's why the reason that UNCLOS have to be amended. The amendment of UNCLOS seems to be desired to include as follows: requirement of prior notification for passage of warships and vessels carrying ultra-hazardous substances including nuclear materials; boarding, inspection and seizure of vessel to prevent the proliferation of Weapons of Mass destruction(WMD) in the high seas as well as territorial seas.
