전자감독 특별사법경찰제도의 도입 효과와 발전방안: 신속수사팀을 중심으로

Abstract

The Electronic Monitoring Special Judicial Police System, introduced to prevent recidivism among electronic monitoring subjects, plays a crucial role in closely managing the behavior of high-risk offenders and reducing the likelihood of reoffending. However, the existing electronic monitoring system has revealed structural limitations, such as delays in case handling due to its reliance on the police, lack of consistency in management, and insufficient human and material resources for probation officers. To address these issues, Special Investigation of Electronic Supervision, SIES, was established in 2021. SIES operates with special judicial police authority to promptly respond to violations of compliance conditions and incidents involving the tampering of electronic devices by monitoring subjects. This study analyzes the operational performance of SIES during its first year and derives improvement measures to enhance the effectiveness of the system through in-depth interviews with practitioners. The analysis highlights the need for stricter sanctions against non-compliant individuals, the expansion of investigative personnel and resources, and the standardization of compliance monitoring criteria. Additionally, strengthening information exchange with crime prevention teams and systematizing work schedules to minimize investigative gaps were identified as critical tasks. Furthermore, the introduction of training programs aimed at improving investigative techniques and enhancing job competencies is emphasized as essential to increasing expertise. These findings provide significant insights into improving the efficiency of managing electronic monitoring subjects, strengthening recidivism prevention, and enhancing the effectiveness of law enforcement. They also contribute to the sustainability and long-term development of the system.
