아랍인권헌장에 대한 고찰-형성과정과 개인 & 약자권리를 중심으로-

아랍 권과 이슬람 권에서 인권헌장이 문서로 채택된 이 사실 하나만으로도 역사적으로 상당한 의미가 있다. 2004년 버전 아랍인권헌장은 제1조 1항에서 ‘인권을 아랍국가들의 주요 관심사들 중에 핵심에 둔다’고 한 것만 보아도 아랍사회가 인권정책에 대한 중요성을 인식하고 있음을 알 수 있다. 이를 통하여 인간다운 삶을 보장∙실현하려는 의지가 강하게 표출된 된 것으로 볼 수 있다. 아랍인권헌장에서 개인의 권리부분에서는 개인의 인권보호를 위한 장치로 53개 조항가운데 무려 10개조항을 배치하였으며 좀더 이 범주를 확대하면 시민의 권리, 문화생활을 누릴 권리, 보건의 권리 등이 포함되어있다. 장애인 부분에 있어서는 소프트웨어는 되어있지만 하드웨어가 이를 제대로 못 따라가고 있어 좀 더 구체적이고 실현 가능한 조항들이 삽입되어야 할 것이다. 여성부분은 1994년 버전에 비해서 2004년 버전에서는 인권향상을 실현하려는 조항들이 늘어났다. 그러나 남∙녀간의 불평등을 해소하기 위해서는 조건의 불평등을 제거하는 하는 것이 급선무라고 본다. 결론적으로 인권에 대한 조항들이 상당히 구제화되어 있음에도 불구하고 외부의 시각은 아직 많은 이슬람국가들이 지난 세기와 21세기에도 민주주의와 인권에 인색하며 인권의 훼손이 이슬람에 뿌리를 두고 있다고 비난하고 있다(Monshipouri: 42). 이에 대하여 이슬람권에서는 문화적 상대주의로 이를 이해해야 한다고 주장하고 있다. 그러나 본 연구를 통하여 아랍인권헌장을 고찰해본 결과 광범위한 내용들이 명문화 되어있지만 이것이 정상적으로 작동하기 위해서는 아랍연맹의 회원국들이 아랍인권위원회에 좀 더 강력한 힘을 실어 조사보고 및 사후개선조치가 신속히 이루어지도록 해야 할 것이다.
Abstract
This paper aims to study on the Arab Charter of Human Rights: Focusing on the birth process and the Rights of Individual and of the Weak. The researcher examines the background of the formative process of the Arab Charter of Human Rights and the contents of the Arab Charter of Human Rights which was revised in 2004, which plays the important role as the basis of the policy of the human rights in the Arab world. The researcher concentrates on the three rights, which are related to the individual rights, the rights of disabilities rights and the rights of the woman and also estimates that the revised version of the Arabic Charter of Human Rights in 2004 has significantly improved human rights by placing human rights at the center of national preoccupation in the Article 1. And although the 2004 version contains a wide range of human rights issues, the mechanism is somewhat lacking, which requires a lot of the positive activities of the Arab Human Rights Commission.
