Abstract

This study scrutinizes the Buddhist Vinaya’s stance on the moral responsibility of agents with mental disabilities through the prism of Article 10 of the Criminal Code, which differentiates among “insanity,” “temporary insanity,” and the doctrine of “actio libera in causa.” The first two legal rubrics correspond to the Vinaya designations chikuang (癡狂, madness) and xinluan (心亂, mental turbulence). Drawing on the Nanti (Nandika; 難提) and Bozhenanti (鉢遮難提) cases preserved in the Mahāsāṃghika Vinaya, the text pronounces non-guilt whenever intention is absent and memory inaccessible owing to such impairment. The Vinayas also canvass scenarios analogous to actio libera in causa, in which an agent deliberately annihilates her own capacity for culpability before the offense. A salient example appears in the Sarvāstivādavinayamātṛkā: an agent, having engineered her slumber, causes her mother’s death; because the homicidal purpose was fully formed during preparation, the act is classified as a Pārājika offense—the gravest transgression. The Dharmaguptaka Vinaya’s doctrine of yifa (倚發) further bifurcates the inception of criminal intent from the act’s consummation. Within the Brahmāʼs Net Sūtra, mens rea likewise constitutes the decisive touchstone for major offenses. Interpretations, however, diverge over the notion of cause (因). Wonhyo (元曉) restricts the “direct cause” to specific criminal intent, foregrounding the agent’s psychological state as the primary yardstick of responsibility. Seungjang (勝莊), by contrast, subsumes under the direct cause both concrete desire (欲樂) and the defilements of greed, hatred, and delusion, yielding a more expansive attribution of blame. Thus the Buddhist precepts adjudicates culpability by calibrating intention against mental condition—a hermeneutic with constructive implications for Buddhist ethics and legal philosophy.
