本論文は‘国会のヴィコシティーを活用した野党の立法影響力はなぜ失敗したのか’に問題意識を持ち、安保法制の立法審査過程をその事例として選択し、日本国会のヴィコシティーとそれを利用する野党の立法影響力を分析した。具体的に本論文においては、日本国会のヴィコシティーを高める要因を「制度・慣行・世論」の三つで分類し、安保法制の立法審査過程への影響を詳しく分析した。その結果、野党は会期制に大きく依存していることを確認し、それとともに法的・制度的な限界と野党結集の問題が野党のヴィコシティー活用能力を大きく制限していることも明確にした。
Abstract
This paper analyzed the legislative influence of the Japanese National Assembly's Viscosity and the legislative influence of the opposition party using Viscosity by selecting the legislative process of the security legislation as an example. Specifically, in this paper, the factors that increase the Japanese National Assembly's Viscosity are summarized into three categories: system, practice, and public opinion. I examined in detail how the opposition party used it and was restricted in the process of reviewing the security legislation. As a result of the analysis, it was found that institutional limitations and the problem of gathering opposition parties greatly restrict the use of the opposition party's viscosity, along with the fact that the opposition party relies heavily on the session system of the Japanese National Assembly.
