한국이 짧은 시간에 만들어낸 놀라운 경제발전은 개발도상국들에게 희망이 되었다. 국제사회에서 한국의 역할은 그 경험을 공유하여 개발도상국들의 수준을 높이는 것이다. 공적개발원조(ODA)의일부로 수행되는 한국정부의 법제교류지원은 개발도상국에게 ‘법의 지배(rule of law)’를 주입하는 중요한 작업이다. 그러나 한국의법제교류지원 활동은 아직 발전해야 할 부분이 많다. 많은 메콩강 유역 국가들은 한국 ODA 활동의 일부인 법제교류지원 사업에서 중요한 대상국이다. 한국 정부와 법원이 진행해온법제교류지원 활동의 여러 사례를 검토한 결과, 한국의 메콩강 유역 국가들과의 법제교류지원 사업의 특성을 확인할 수 있었다. 그결과 미래의 한국의 법제교류지원에서 차별화될 수 있는 특수한 분야를 만들어내는 것이 중요한 과제임을 발견하였다. 이러한 활동은국내기업과 국민의 해당지역 활동에서 편안함을 제공할 수 있을 것이고, 국제사회에서 한국의 법제위상을 확립할 수 있을 것이다. 메콩강 유역 국가들의 상황들을 고려할 때, 구체적으로는 한국의경제개발과 관련된 경험을 전달하는 법제도, 외국인투자를 촉진하기 위한 관련 법제도 등을 우선 교류와 지원의 대상으로 고려하는것이 유리할 것이다. 또한 특정 분야의 산업을 발전시키기 위한 법적인프라 조성에 관하여 지원을 집중하는 것도 필요하다. 법이 갖는 특수한 성격을 고려하면, 법제교류지원은 대상국의 적극적인 참여 또는 주도를 이끌어내는 것이 필수적이다. 한편으로는 국제기구나 제3국 정부와 협력하여 활동을 하는 것도 필요할 것이다.
Abstract
The surprisingly extreme economic development of South Korea within such a short time has become a hope to other developing countries. Korea’s role in the International Society is mainly comprised of sharing its experience and helping others to rise to Korea's level. As one part of Official Development Assistance(ODA), legal exchange support of the Korean government has much importance in terms of driving the concept of ‘rule of law’ in developing countries. Such activities can provide easiness and comfort for domestic enterprises and then raise Korea's legal status in the International Society. Unfortunately, there is still much room for improvement in the legal exchange support of Korea. Mekong-basin countries have been the main targets of legal exchange support as part of Korean ODA activities. After studying several activities by the Korean government and court, the study classified the basic characteristics of the Korean law exchange support works with Mekong-basin countries. Considering the circumstances of Mekong-basin countries, for example, it will be advantageous if the legal systems for sharing Korean economic development or promoting foreign investment became the subject of concern. Fostering legal infrastructures for developing specific fields will be needed soon. Then, when we consider a uniqueness of law, drawing active participation or leading roles of recipient countries will be essential. Taking this into account, cooperation with international organizations or a third party may be needed.
