테러리즘의 도덕적 정당성에 관한 고찰

이 글의 목적은 테러리즘의 여러 원인들을 분석하면서 테러리즘의 정당성을 비판적으로 검토하고자 함에 있다. 이러한 과정을 통하여 테러리즘 자체가 안고 있는 폭력의 비도덕성을 지적하면서, 테러리즘의 근본적인 해결을 위한 현실적인 과제들을 제시하고자 한다. 일반적인 폭력과는 달리 테러리즘은 그 수단이나 과정, 그리고 결과의 측면에서 볼 때 사전에 치밀하게 계획되며, 극단적이면서도 무자비한 폭력을 무고한 사람들에게 자행한다는 점에서 도덕적으로 문제시 된다. 테러의 원인들은 여러 요소들이 서로 복합적으로 맞물려 있는데, 그 근저에는 미국 중심의 신자유주의적 세계화로 인한 불평등의 결과라고 할 수 있다.테러리즘은 정당전쟁론에 근거하여 그 정당성을 제기한다. 만약 테러리스트가 행한 폭력이 치명적이거나 파괴적으로 의도된 행동이 아니라 공적인 행동이라면, 또한 그 행위가 적법한 권한을 가지고 있는 공적인 실체에 의해서 이루어졌다면, 이는 정당하다고 볼 수 있다는 것이다. 문제는 테러리즘이 현실적으로 정당한 전쟁의 규약을 지킬 수 있는가에 달려 있는데, 이는 현실적으로 불가능하다고 판단된다. 또한 테러의 결과로 말미암은 혜택이나 선이 테러과정 중 초래된 해악이나 고통을 능가한다고 해서 정당화될 수 없다. 따라서 테러리즘은 첫째, 무차별적인 폭력의 성격을 지닌다는 점에서, 둘째, 무고한 불특정 다수가 피해를 입고 희생된다는 점에서, 셋째, 폭력만이 유일한 해결책이 될 수 없다는 점에서 그 정당성을 상실하게 된다. 테러리즘을 해결하기 위해서는 장기적인 전망 속에서 다각도로 이루어져야 한다. 우선 지구촌의 분쟁과 갈등에 대한 해결은 서로의 차이점을 그대로 인정하고 존중하면서, 타자를 환대하는 가운데 시작되어야 하며, 분쟁과 갈등의 근본적인 원인이 되는 지구촌의 불평등과 불공평을 해결하는 것이 시급하다. 이를 위해 소외된 제3세계의 빈곤해소와 피억압자들에 대한 이해증진과 인권증진을 위한 다각적인 노력과 수고가 요청된다. 이들에 대한 의료지원과 더불어 기초생활권이 보장될 수 있도록 지원하고, 아울러 경제적으로 자립할 수 있도록 사회 간접자본과 기초산업을 육성할 수 있는 근본적인 지원을 병행하여야 한다. 또한 국제관계에서 발생하는 갈등과 분쟁은 강자에 의한 힘의 논리가 아닌 객관적이고 균형 잡힌 정의의 원칙에 기반을 두어 해결되어야 한다. 이를 위해 국제 협약을 존중하도록 하고, 국제적 정의가 요구하는 바와 같이 부유한 자로부터 가난한 자들에게로 자원의 공정한 분배가 이루어져야 한다. 이러한 노력들은 모두가 서로 용서하고 화해하는 생명문화의 산실을 주도적으로 만들어가는 계기가 될 것이다.
Abstract
The purpose of this paper is to survey the several causes of terrorism and then to critic the legality of terrorism. Through this course, I‘ll prepare realistic solutions for these problems. Unlike general violence, terrorism has many moral problems because it uses radical and ruthless violence against innocent people. Terrorism breaks out from several problems and these problems are complex and interrelate. The prime cause of terrorism emerges from globalization of new liberalism which produces unequality in the world. According to Wilkins, terrorism is justified as a form of self-defense and just war theory. First, terrorism should be limited to the members of the community which are collectively guilty of violence. Second, as far as possible, terrorism should be confined to primary targets and not secondary targets. The problem is that these rules are realistically impossible to keep. Therefore terrorism loses justification because of indiscriminate violence and vulnerability of the innocent. Nonviolence is an efficient solution to this problem. To solve the problems of terrorism, first we must find the essential and fundamental root of unequality and eliminate it. We take to mind the hospitality that acknowledges and respects the difference of others. We have to prepare elementary support programs and medical services for the third world. From the long term perspective, we must support the economical background so that they may develop strong industry. These efforts will provide the community of coworker and coexistence. Also we control and negotiate conflict and strife through the justice of international law. To achieve this goal, we must respect international law and distribute equally their resources. We must solve indigence of the third world and improve human rights of the oppressed.
