초록

Se examinan las acciones legislativas, propuestas y políticas públicas adoptadas por distintos niveles del Estado mexicano para dar respuesta a la problemática de la violencia de pareja en contra delas mujeres. Se muestra como en ocasiones las acciones del Estado responden a intereses políticos partidistas, o al contexto político y social.Éstas pueden estar más ligadas con la búsqueda de legitimidad del propio Estado que con garantizar y proteger los derechos de las mujeres.Esta evidencia, si bien no desdeña los beneficios que esta legislación puede comportar para las mujeres, suscita preguntas sobre el papel del Estado como garante de derechos y su función de representante de intereses sociales.

Abstract

This article examines some legislative initiatives,laws and public policies adopted by the State in Mexico –Federal and State-levelaiming to address the phenomenon of partner violence against women. Framed in the theories of legislative diffusion and by using a series of interviews conducted with key actors, shows how the approval of family violence legislation in Mexico has followed three different paths: a) collaborative effort between the State and NGOs/women’s movement; b) up-down or reforms driven from above; and, c) bottom-up or reforms driven from below. In some cases, and dependent upon historical, political and social circumstances, there is a tendency from the different levels of the Mexican State to use the issue of violence against women as a mechanism for increasing its own degree of legitimacy, either at the international or state level. Regardless the State motivation,women have benefited from this legislation. Nevertheless some questions arise regarding the role of the State as a grantor of women’s rights and as a representative of social interests.
