초록

본 연구는 일명 ‘구리법’이라 불리는 칠레의 구리보존법 또는 구리배당법에 관한연구이다. 20세기 중반 제정된 칠레의 구리법은 자원산업과 국방예산이 연계된 드문 사례의 법이다. 그러나 민주화 이후 구리법의 존폐는 칠레 사회에서 논쟁의 대상이었다. 본 연구는 칠레 구리법 정책의 결정요인을 도출하는 것을 목적으로 한다. 본 연구에서제시된 증거들로 볼 때, 구리법의 폐지는 칠레의 광범위한 정치사회세력들로부터 지지또는 묵인을 받고 있다. 특히 주목할 점은 구리법 폐지 논쟁이 CODELCO 민영화 논쟁과는 달리 광범위한 반대세력의 형성을 가져오지 않았다는 것이다. 즉 수십 년간 칠레사회에서 지속된 CODELCO 민영화 논쟁에서 CODELCO 민영화를 강력하게 반대했던 군부와 노동조합 그리고 좌파정당은 구리법 존속에 찬성하지 않았다. 결국 이는 2012년 칠레 하원에서 구리법 폐지 법안이 만장일치로 통과되는 결정적 요인이 되었다고 본연구는 결론짓고 있다.

Abstract

The paper is about so-called ‘Chilean copper law’ which can be also known as ‘the Copper Reserve Law(Ley Reservada del Cobre, No.13,196).’ The copper law is an unique law which relates defense budget to natural resource. It guarantees the Armed Forces 10 percent of total export achieved by CODELCO, the state-owned world largest copper company. Because of its peculiar form of budgeting the national defense, the copper law has been the center of discussion in Chile. The main purpose of this paper is to elucidate the determinants of politics of copper law in Chile. According to the evidences presented in the study, the copper law can be repealed, because the possible political forces have not participated in the coalition against the abolition of copper law. Traditionally powerful political forces against the privatization of CODELCO- the leftist political forces, the military, and the labor union of CODELCO- do not support the political forces against the abolition of copper law. In this sense, the political forces against the abolition of the copper law is very weak in Chile. The study concludes that the Chilean copper law is to be repealed and new scheme of defense budget is to be introduced.
