본 연구는 19세기 초 스페인으로부터 각각 독립한 이후 지속되다 1998년체결된 평화협정으로 종식된 에콰도르와 페루 간의 국경 분쟁에 관한 연구이다. 170년 이상 지속된 에콰도르와 페루의 국경 분쟁은 서반구 최장의 국경 분쟁의 하나에서 모범적인 국경 분쟁의 해결방법을 제시한 사례이다. 에콰도르와 페루의 국경 분쟁의 과정과 해결은 보장 국가 및 그 대리인을 통한중재 체제, 중재국에 의한 추가 사항 중재, 창의적인 국경 지역 정리, 추가 사항을 포괄한 교역 및 항행 협정, 수자원 공급 문제 해결 등 제도적 측면뿐만아니라 실질적 측면에서도 국경 분쟁 해결의 중요한 시사점을 지니고 있다. 이에 본 연구는 에콰도르와 페루 간에 벌어진 국경 분쟁의 배경, 전개 그리고 결말을 중심으로 한 역사적 과정과 그 의미를 분석하는 것을 목적으로 한다. 본 연구는 다음의 함의와 결론을 제시하고 있다. 첫째, 에콰도르와 페루의 국경 분쟁 해결 사례는 아무리 복잡하고 오래된 국경 분쟁일지라도 올바른 원칙과 방법으로 접근하면 평화적 해결이 가능하다는 것을 입증하고 있다. 둘째, 에콰도르와 페루의 국경 분쟁 사례는 미국, 브라질, 아르헨티나, 칠레 등 보장국의 역할을 통하여 국제 국경 분쟁 해결에 있어서 중재국 또는제삼자 개입의 중요성을 보여주고 있다. 셋째, 에콰도르와 페루의 분쟁해결사례는 평화협정 체결과 평화공원 조성 및 관리라는 이례적인 갈등 해결방법을 통해 영토와 국가의 주권에 대한 새로운 접근법을 제시하고 있다. 네번째이자 마지막으로, 에콰도르와 페루의 국경 분쟁 해결의 사례는 분쟁 해결의 중요한 변수의 하나로 분쟁 지역이 지니는 경제적 가치의 중요성을 다시 한 번 확인해 주고 있다. 즉 에콰도르와 페루는 분쟁 지역의 불확실한 부존자원 대신 분쟁 해결로 인한 양국 간의 경제 교류 증대, 정치적 불안 제거로 인한 직접 투자 확대, 군비 감소, 그리고 직접적 경제적 원조 확대 등의 확실한 현재를 선택하였다.
Abstract
In the early 19th century, Ecuador and Peru achieved their independence and began one of the most protracted border conflicts in the western hemisphere. Because of unclear border lines between the two countries since their independence, the border conflict between Peru and Ecuador triggered 34 military conflicts between 1828 and 1998. However, this long territorial conflicts became rather swiftly resolved in 1998 with a peace agreement and it gives us valuable lessons regarding resolution of territorial conflicts. This study attempts to develop a historical analysis focusing on background, development process and results of the territorial conflict between Ecuador and Peru. We could learn following lessons regarding conflict resolution from a unusual option that Ecuador and Peru chose to solve their problem: peace agreement and foundation of a peace park. First, it is important to respect basic yet simple principles and methods in solving rather complicated territorial problems. Second, in Latin America, the Guarantor states play a significant role in resolving territorial conflicts. Finally, the peace park that Ecuador and Peru agreed to build in the conflict area shed lights on a new strategy to solve territorial conflicts in our times.
