Abstract

In modern society, characterized by complexity and diversity, the issues Issues such as the economic crisis, social inequality, and climate change have exacerbated public conflict. Administrative agencies carry out a range of functions aimed at serving the public interest. However, in a pluralistic society, it can be quite challenging to reach a consensus on what constitutes the public interest, as not all citizens may agree. Conflicts in public decision-making often originate from competing interests, inequitable distribution of resources, and a lack of transparency and procedural fairness in the policy formulation process. In this context, a range of theoretical frameworks have been developed to address public conflicts and enhance the legitimacy of public decisions. For example, the theories of civic republicanism and deliberative democracy are theories that emphasize citizen participation and deliberation. However, in practice, achieving consensus through deliberation poses significant challenges, and the resulting decisions are often seen as not having sufficient legitimacy. To address these issues, complementary theories such as ‘relational fairness’ and ‘administrative agon’ have been developed. ‘Relational fairness’ aims to build new democratic relationships by providing opportunities for all stakeholders to participate in the administrative decision-making process. Furthermore, the theory of ‘administrative agon’ acknowledges the inevitability of conflict and seeks to enhance the legitimacy of administration through a dynamic and continuous process. This theoretical framework addresses the limitations of traditional procedural theory by offering a new approach to managing the pluralism and conflict inherent in modern society.
