숙의민주주의는 참여민주주의의 발전 과정으로 국민의 성숙한 논의를 목적으로 한다. 숙의민주주의 실현을 위한 다양한 형태의 공론화 논의가 존재한다. 공론화의 대표적 형태인 공론조사의 경우, 참여자가 대표성을 가져야 하며 참여자간 실질적인 논의가 이루어져야 한다. 공정한 참여자 선정을 통해 지역‧연령에 따른 의사 결정의 편향성이 완화되고, 사안에 대한 실질적 논의가 이루어져야 국민에 의한 의사결정과 사회갈등의 해소라는 공론화 본연의 역할을 수행할 수 있다. 숙의는 깊이 있는 사고와 토론을 통해 사안의 해결을 도모하는 집합적 활동이라는 점에서 투표로 인해 결정하기 어려운 사안을 논의하기에 적합하다. 그러나 대의민주주의 또한 숙의의 요소를 포함하는 만큼 대의민주주의에서 숙의가 이루어지지 않는다는 오류를 범해서는 안된다. 행정사무의 위임에 있어 수임기관은 의사결정의 위임을 통해 본래 행정사무를 담당한 행정기관과 유사한 역할을 수행한다. 의회의 행정부에 대한 권한 부여는 행정기관이 직접 소관 사무를 처리할 것으로 전제한다는 점에서 국민의 권리‧의무와 관계된 행정사무의 민간위탁을 위해서는 법률의 근거가 요구된다. 그러나 공론화는 국민에 의한 행정행위의 수행이며, 행정기관이 공론화 논의 여부를 직접 결정한다는 점에서 법률에서 별도의 절차가 규정되지 않는 한 법적 근거가 요구되지 않는다. 행정기관은 정책의 정당성과 더불어 정책결정의 효율성도 고려해야 한다는 점에서 숙의를 통해 구체적인 결과의 도출이 가능한지, 찬/반 형태의 숙의로 인해 국민의 의사가 왜곡될 수 있는지 검토되어야 한다. 공론화에 적합하지 않은 사안이라도 국민의 직접 참여를 통한 정책의 정당성과 정책결정의 효율성 등을 고려해 공론화가 필요하다면 공론화에 적합하도록 논의 범위를 변경할 필요가 있다. 공론화의 효율적인 논의를 위한 상시기구의 설립을 검토할 필요가 있다. 공론화 전담기구의 법적 제도화는 공론화의 공정성과 전문성을 담보할 수 있으며, 공론화 논의 사례가 축적될수록 효과적인 국민의견 수렴이 가능하다는 점에서 숙의민주주의 발전에 기여할 수 있다.
Abstract
Deliberative democracy based on participant’s learning makes it possible for our society to have mature discussions in the process of developing a participatory democracy. Though various forms of public discussing exit for achieving a deliberative democracy, public polling, one of the most frequently used methods, requires that participants have to represent the general public and those who participate in this discussion have to hold substantial and practical discussions. A fair selection of participants is required to guarantee an representation of a group without a bias of age and region. Substantial and practical discussions are required to fully achieve the original purposes of public discussing which are decision making by the general public and helping resolve social conflicts among the members. Deliberation is group activities trying to coming up with solutions through deliberation and discussions which is suitable for resolving the cases which cannot be addressed by voting. In contracting out administrative affairs, the entrusted agency performs similar roles to the administrative agency through delegating decision-making authority. Parliament grants executive power to the administration, which presupposes that the administrative agency directly deals with the affairs of its jurisdiction. Therefore, the contracting out of administrative affairs needs legal grounds. The decision through public opinion formation means performing administrative acts by the people. Unless a separate procedure is stipulated by laws, decisions based on public opinion formation can be possible without any legal basis. The administrative agency’s policy should have justification as well as efficiency so that through deliberation based on pro and cons. For the issue that requires deliberation but is not suitable for public opinion formation, it is necessary to adjust the scope of the issue to suit the public discussion rather than unconditionally excluding Lastly, permanent body needs to be set up for efficient discussion of public discussions. By legally institutionalizing a permanent body the fairness and professionalism can be guaranteed. As more and more cases for public discussions are built up efficient acceptance of general public’s opinion is possible and it will lead to development of deliberative democracy.
