Abstract
This study examines the social mechanisms that enabled the maintenance of transactional order in Joseon society, where hwan'toe(還退)—the rescission of a completed sale and the return of the transacted item—was a recognized custom. In Joseon, hwan'toe took place not only when it had been explicitly stipulated in the written contract at the time of transaction, but also when one party demanded it despite no such provision. When the counterparty refused such a demand, the matter could escalate into litigation. In adjudicating hwan'toe disputes, local magistrates(songgwan, 訟官) accepted the practice within the bounds of shared communal values, such as preserving inherited family property and protecting the property for ancestral rites. By contrast, when hwan'toe was abused for unjust gain, resulting in harm to the other party, local magistrates regulated such acts that undermined both transactional order and communal values. By balancing respect for shared communal values with efforts to regulate disturbances in transactional order, Joseon society maintained social stability. Yet this system had an inherent limitation in that it was vulnerable to the abuse of power within the community.
