Abstract
The application of artificial intelligence to alternative dispute resolution (ADR) can be traced back to the 1970s, reflecting a long-standing history of technological experimentation in this field. As generative artificial intelligence(generative AI) has recently gained significant attention, new efforts have emerged to integrate this technology into ADR processes. These efforts span a broad spectrum, ranging from the use of generative AI as a decision-support tool to more ambitious inquiries into whether it could ultimately replace human dispute resolvers. Consequently, scholarly discourse on generative AI in dispute resolution has expanded in both scope and complexity. This article focuses on mediation as a central form of ADR and examines the potential roles, impacts, and limitations of generative artificial intelligence within the mediation process. Generative artificial intelligence may assist mediators across multiple stages of the mediation process. In particular, it has the potential to enhance procedural efficiency through automation, improve communication between mediators and parties, and support the generation and presentation of settlement proposals. A key question addressed in this article is whether generative AI can supplant human mediators. At present, generative AI does not appear capable of fully replacing mediators and is more appropriately understood as a complementary tool that augments human decision-making. Nonetheless, in light of ongoing technological advancements, the possibility that generative artificial intelligence may one day replace human mediators cannot be categorically excluded.
