Abstract
This article seeks to provide an overview of the activities of the Democratic Legal Studies Association(DELSA) as an organization of the academic movement in the area of transitional justice movement from 1989 to 2024. This author first explains the issues of the transitional justice legal scholarship, divides the political period of transitional justice, and outlines the academic activities of the DELSA members. Despite the repeated political advances and regression since democratization, the members held numerous policy discussions in solidarity with the Association of the Bereaved Families of Massacre, various victim groups, lawyer groups, overseas researchers, National Assembly offices, and national committees, and concretized the debate from legislative proposals to case law critiques centered on the journal Democratic Legal Studies. Democratic Legal Studies has planned several special issues on transitional justice since the ‘normative evaluation of May 18’ in 1995. A significant number of members have actively participated in various national commissions on transitional justice. However, because a strong hegemony for transitional justice has not been formed in Korean society, the political work of transitional justice has been unstable, and the goals and achievements of the DELSA group have been seriously restricted. Looking ahead, the transitional justice in Korea should still be based on a comprehensive program, not on individual solutions, and overcome ideological discrimination in victim recognition. The transitional justice movement calls for a more humane society beyond a society governed by law. At the end of this movement, there remains a bigger and higher task of reunification that needs to be challenged. In the phase of reunification, restorative justice will have to take center stage instead of retributive justice.
