Abstract

In the history of the democratic legal studies movement (1989~2024), criminal jurisprudence as a democratic legal studies takes democracy and reformability (scientific and practical) as its identity. This paper divides the democratic criminal legal studies movement into three periods according to the direction and focus of the legal struggle: the period of the struggle to abolish evil laws(legislative level), the period of judicial democratization(trial level), and the period of reforming the national criminal justice system(legislative and trial level). Upon this frame, it analyses the 35 years of the “democratic criminal legal studies” in each period using the 32 articles published in the journal of Democratic Legal Studies as the basis to identify the identity of the “democratic legal studies school”. This is to look ahead to alternative agendas and tasks that go beyond setting oppositional agendas in continuing the history of the democratic criminal justice movement. In the current Korean society in the fisrt quarter of the 21st century, criminal justice institutions have become more than anti-democratic tools, but reactionary challenges to democracy. Reforms have been carried out in the name of ‘adjusting’ investigative powers and reorganizing investigative structures, but the true demands have been democratic reformation of criminal justice institutions. If the democratic criminal legal studies movement fails to set an agenda for change in the criminal justice reform process and enters the discussion according to the reform agenda given by the existing system, it may be trapped in the limitations of liberal jurisprudence. It may also fail to distinguish the progress of criminal law from progressive criminal law. The key is to have an agenda that concretely demonstrates how the democratic jurisprudential alternative is different from the regime jurisprudence solution and why the former is more effective. We need a new agenda, an alternative agenda that goes beyond the oppositional agenda. For the economy and business, labour rights and rights to safety; for equality, gender equality; and for the environment, social disasters and the climate crisis should be embraced as the agenda of democratic legal studies movement. Democratic criminal justice should set crime and punishment as a progressive political agenda. Progressive criminal jurisprudence seeks to counter conservative and regime-maintaining criminal policies by understanding crime issue as a social democratic task and as an opportunity to strengthen democratic principles.
