Abstract

AI as a term was first coined by John McCarthy in the Dartmouth Summer Research Project of 1956. McCarthy defined AI as a machine that behaves in ways that would be called intelligent if a human were so behaving. Artificial intelligence is a form of “intelligent computing” in that it relies on computer programs that can sense, reason, learn, act, and adapt much like humans do. It is “intelligent” because it emulates human cognition. It is “artificial,” because it involves computational rather than biological information processing. Technically, AI is mainly powered by machine learning algorithms, i.e., algorithms that change in response to their own received inputs and consequently improve with experience. The increasing use of AI and autonomous systems will have revolutionary impacts on society and there are many things we do not know about how AI will impact the law. There is a argument whether we could imagine a human-level AI that demands constitutional rights and should that entitle them to constitutional rights for AI. It could be possible that we can grant the constitutional rights similar to those of corporations and agents for AI, but we are not unable to recognize constitutional rights for AI because they are not natural humans. The reason is as follows. Though AI has consciousness, self-consciousness, autonomy and cognitive abilities, he cannot has ethical personality. Objectivity is not one of AI’s virtues. Rather, algorithms reflect back the biases in the programming that are input when models are designed and in the data used to train them. Modern constitutional principle is based on the premise that ethical human being as a constitutional human character is essential for the prevent and removal of threat to humanity and the improvement the quality of life.
