대한변협이 발행하는 유서 깊은 학술지인 「人權과正義」는 매년 봄이면 실무가들을 위하여 전년도에 선고된 중요 판례를 각 분야별로 선별하여 게재하고 있다. 이 논문은 2017년에 나온 운송법과 보험법 관련 대법원의 판례들 중에서 중요한 것을 엄선하여 검토한 것이다. 다만 작년의 경우 운송법 관련 2016년 판례가 누락된 관계로 이번에 2016년과 2017년 판례를 함께 소개하게 되었다. 그러나 필자의 관점에 따라 중요 판례를 선정하였기 때문에 논자에 따라서는 동의하지 않을 수도 있을 것이다.
Abstract
This article introduces and reviews on the Supreme Court Cases dealing with critical jurisprudence in 2016∼2017 focusing on transportation law and insurance law. Although, as Supreme Court Cases relating to transportation law were omitted in last year, in this article decisions rendered by the Supreme Court in 2016 are added. However, since major cases were selected from the writer’s viewpoint, some readers might not agree on these selections.
