대한변협이 발행하는 유서 깊은 학술지인 「人權과 正義」는 매년 봄이면 실무가들을 위하여 전년도에 선고된 중요 판례를 각 분야별로 선별하여 게재하고 있다. 이 판례평석은 2019년에 나온 운송법과 보험법 관련 대법원의 판례들 중에서 중요한 것을 엄선하여 검토한 것이다. 다만 작년의 경우 운송법 관련 2018년 판례 중 하나(2015다246186 판결)가 빠졌던 관계로 이번에 이 판례를 함께 소개한다. 그러나 필자의 관점에 따라 중요 판례를 선정 분석하였기 때문에 논자에 따라서는 동의하지 않을 수도 있을 것이다.
Abstract
This judicial review introduces major decisions of the Supreme Court in 2019 focusing on transportation law and insurance law. Although, as one of the Supreme Court Cases relating to transportation law was omitted in last year, in this judicial review the case about shipping agent rendered by the Supreme Court in 2018 is added. However, since major cases were selected from the writer’s viewpoint, some readers might not agree on these selections.
