Abstract

This study aims to examine the historical origins of the German Lastenausgleichsgesetz (Equalization of Burdens Act) of 1952, the debates surrounding its enactment, and its socioeconomic effects, while also considering the contemporary relevance of the Burden Equalization policy. The term Lastenausgleich implies that the economic burdens borne by a specific group are to be shared by the broader community, and it further carries the practical connotation of state-led financial support for that group. The term also refers directly to the 1952 law, which provided economic assistance to Germans expelled from Central and Eastern Europe after the Second World War, as well as to those who suffered property losses during the 1948 currency reform or bombing during the war. During the COVID-19 pandemic, some figures within left-wing parties in Germany invoked the 1952 precedent and advocated for a new form of burden equalization to support socioeconomically vulnerable groups afflicted by the crisis. However, the Advisory Board at the Federal Ministry of Finance (Wissenschaftlicher Beirat beim Bundesministerium der Finanzen) opposed such measures, arguing that financing a new burden equalization through a capital levy could unduly infringe upon individual property rights. In addition, critics contended that identifying those directly affected by the pandemic would be difficult, and that the administrative costs required to implement such a policy would be prohibitively high — points that formed core arguments against a “burden equalization” for the twenty-first century. Before dismissing the feasibility of such a policy, however, it is worth recalling that the German parliament and government, despite intense controversy, enacted the Lastenausgleichsgesetz in the early 1950s — at a time when the postwar economic situation was far more difficult than in the early 2020s. With this in mind, the present study investigates the political and social circumstances that made it possible to institutionalize the Burden Equalization that inevitably entailed immense costs amid the severe crisis of the postwar period, as well as the underlying spirit of social consensus that supported it. It further examines how the law contributed to alleviating the radicalization of German Expellees of roughly eight million — many of whom had fallen into poverty — and to easing broader social instability. Through this analysis, the paper argues that a “twenty-first-century burden equalization” could serve as a plausible policy option not only in Germany but also globally, as a means of mitigating socioeconomic inequality.
