국제인권조약 자동승계론에 관한 연구: 남북통일과 관련하여

초록

국제인권조약은 국가승계와 관계없이 승계국에 자동적으로 승계된다는 주장이 1990년대 중반 이래 꾸준히 주장되고 있다. 이 주장에 따르면 북한이 당사국인 국제인권조약은 자동적으로 통일한국에 승계되므로 이 주장은 국제법의 견지에서 뿐만 아니라 우리나라의 법체계에 있어서도 중요한 의미를 갖는다고 말할 수 있다. 이 글의 목적은 현 시점에서 국제인권조약의 자동승계가 국제관습법화되었는가의 여부를 살피는 것이다. 이를 위해 먼저 조약의 국가승계에 관한 1978년 비엔나협약, 유엔인권위원회, 자유권규약위원회, 인종차별철폐위원회와 학자들의 입장을 살펴보았다. 이어 홍콩에 대한 주권이양, 구유고연방 해체, 구소련 분리 등 국제인권조약의 자동승계에 관한 사례들을 분석하였다. 국제관습법은 관행과 법적 확신의 두 가지 요소를 필요로 한다. 그리고 관행은 일관되고 지속적이어야 한다. 그러나 분석을 통해 얻은 결론은 행위가 일관되지 못하며 국제인권조약이 자동승계된다는 법적 확신 또한 결여되어 있다는 것이다. 다시 말해 현 시점에서 국제인권조약의 자동승계가 국제관습법화되었다고 보기는 어렵다. 결국 향후 남북한이 통일이 되는 경우 국제인권조약의 승계여부는 일반적인 다자조약의 승계문제 안에서 해결책을 찾아야 할 것이다.

Abstract

Since middle 1990s it is consistently asserted that international human rights treaties automatically succeed to successor state(s) irrespective of state succession. According to this assertion, international human rights treaties to which North Korea is a Party automatically succeeded to unified Korea. Not only in perspective of international law but also in perspective of South Korea’s municipal legal system, this assertion can be regarded as important. In this paper, firstly I endeavor to analyze and appraise views of 1978 Vienna Convention, UN Commission on Human Rights, ICJ, Human Rights Committee, Commission on the Elimination of Racial Discrimination and several scholars. And then I analyze several cases including dissolution of former Socialist Federal Republic of Yugoslavia, separation of former USSR, transfer of sovereignty of Hong Kong to China by United Kingdom. As well known, international customary law is composed of two elements, practice and opinio juris. State practice should be uniform and consistent. However acts of successor states are not uniform. And I deem there lack in opinio juris in state practice. My conclusion is that I do not regard automatic succession to international human rights treaties as international customary law. Therefore we should devise a solution of succession to international human rights treaties in the jurisprudence of succession of general multilateral treaties.
