초록

예상되는 남북한이 통일은 경우 수많은 문제를 야기하는데, 그 중에는 법적 측면의 문제도 있다. 통일을 국제적인 관점에서 볼 때, 국제법적인 규범을 준수해야만 하는데, 이는 통일의 구체적인 방법이 어떠한지에 따라 달라질 것이다. 통일의 방법과 관련해서 남한과 북한이 하나의 새로운 국가 로 통합되는 방법, 남한이 북한을 흡수통일 하는 방법의 두 가지가 있다. 두 가지를 어떻게 보느냐에 따라 북한이 부담한 채무의 승계, 통일된 국 가의 국경 그리고 국제조약의 유효성이 달라질 수 있다. 이 논문은 통일 후 거의 20년이 경과한 독일의 경험을 바탕으로 해서, 두 가지 통일방식이 초래하는 법효과의 차이를 분석ㆍ비교하고 있다.
