Abstract
The U.S. Treasury Department designated Banco Delta Asia SARL as a primary money laundering concern under Section 311 of the USA PATRIOT Act on September 15, 2005 because it represented an unacceptable risk of money laundering and other financial crimes. This is a so-called “secondary boycott” method of financial sanctions. The purpose of this study is to analyze the mechanism of secondary boycott financial sanctions and their effect. This study proposes the ‘Three-Axis Operational Structure Hypothesis’ as an framework to analyze the machanism of the secondary boycott financial sanctions, and hypothesizes that three actuators that directly or indirectly influenced all parties involved are Section 311 of the USA Patriot Act, US dollar hegemony and the name and shame strategy of Financial Action Task Force. Main characteristics of the effect are ‘leverage effect’ and ‘extra-territorial effect’. In actual situations, secondary boycott financial sanctions are developed by combining the three-axis operational structure theory with appropriate execution strategies.
