교통사고에 따른 ‘형사합의금’의 법적 성질과 문제점에 관한 연구

자동차보험과 연계하여 형․ 민사책임을 함께 해결하려는 교통사고특례법상의 특례제도는 ‘형사합의’라는 용어를 회자시켰다. 이때 피해자가 가해자로부터 받는 ‘형사합의금’의 법적 성질을 대법원이 재산상 손해배상금의 일부로 판단하면서 몇 가지 문제점이 나타났다. 뿐만 아니라 이러한 ‘형사합의금’을 담보하는 운전자보험 특별약관이 보험범죄에 악용되는 문제가 있어 이를 보완 후 실손비례보상형으로 새롭게 출시되었지만 여전히 자동차를 이용한 보험범죄를 조장할 가능성이 농후한 상품으로 인식되었다. 따라서 본 고는 ‘형사합의금’의 법적 성질에 대하여 고찰한 후 어떤 문제가 있으며, 이를 담보하고 있는 특별약관이 왜 문제가 되는지에 대해 살펴본 후 이에 대한 대안을 제시하고자 한다. 연구결과 자동차사고에 따른 형사합의금은 과다과소 지급, 편법 양산, 피해자 간의 형평성, 허위문서의 작성 등의 문제가 있음을 발견하였다. ‘형사합의금’을 담보하는 운전자보험의 특별약관은 정부의 형사정책인 불구속 수사의 원칙과 맞물려 자동차를 이용한 보험범죄를 보다 용이하게 하고, 가·피해자 간의 공모에 의한 보험금의 편취 가능성을 높일 수 있으며, 실질적인 피보험자의 보험 보호도 미흡함을 알 수 있었다. 이러한 문제를 개선하기 위해서는 ‘형사합의금’의 법적 성질을 명확하게 할 필요가 우선 있고 이를 근거로 자동차보험약관의 보상책임 조항을 일부 개정할 것을 제안하였다. 또한 ‘형사합의금’을 담보하는 운전자보험 특별약관에 피해자 직접청구권을 명시하고 이와 함께 수사기관과 사법당국의 공조 예컨대 가해 운전자가 운전자보험 가입증명서를 제출하면 피해자와 ‘형사합의’를 한 것으로 간주하게 하는 제도의 도입을 주문하였다. 교통사고처리특례법에 자동차보험은 물론 이렇게 운전자보험까지 연계한다면 지금까지 나타난 여러 가지 문제들을 해결하는 것은 물론 자동차사고에 따른 형사책임과 민사책임을 함께 해결하고자 하는 시도에도 매우 긍정적인 영향을 줄 것으로 사료된다.
Abstract
The special case policy on the Special Case Law Concerning Traffic Accident which ties with automobile insurance to deal with criminal and civil liabilities together has been reminded people of the word 'criminal settlement'. Several issues came to the fore once the Supreme Court of Korea has started to regard the legal concept of 'criminal settlement money' as a part of monetary damages from assailant. Not only that but also the special clause of driver's insurance which guarantees criminal settlement money was often abused in insurance crimes. After modifying these problems, new insurance program with proportional damages was introduced; however, it is still being considered as an insurance with high risk of insurance crimes. Therefore, this study contemplates the legal concept of 'criminal settlement money', then, analyze the problems caused by this and the reason why the settlement money guaranteed by special clause is being a problem, and after all, will provide solutions for this. The study has found several problems of the criminal settlement money such as excess or short payment, cause of expediency, equity between victims and falsification of documents. The special clauses that guarantees 'criminal settlement money', together with the nonrestraint investigation principle, facilitates insurance crimes and have high risk of defrauding damages by collusion between assailants and victims. Also, a weak protection of the actual insurant was one of the problems. To solve these problems, first of all, the legal concept of 'criminal settlement money' should be defined, and based on it, the study proposes to partially renew the articles for liability of indemnity from the automobile insurance clauses. Also, in designed new system that states direct claim on the special clauses, and that considers it as 'criminal settlement' with victims when drivers summit insurance certificate through cooperation between investigative agency and the judicial authorities. Linking the driver's insurance, as well as car insurance, to the Special Case Law Concerning Traffic Accident will not only solve the problems aroused but also is considered to help the settlement of criminal and civil liabilities from car accidents.
