장애유아 의무교육 정책의 차별해소 방안과 과제-「장애인 등에 대한 특수교육법」개정안을 중심으로-

2007년 「장애인 등에 대한 특수교육법」 제정을 통해 장애유아의 유치원 교육과정이 의무교육으로 규정되었으나, 제19조에서 약 70% 정도의 장애유아가 어린이집에 재원하고 있는 보육기관에 대한 간주조항으로 의무교육대상자인 장애유아와 교사, 부모에 대한 차별이 지속되고 있다. 본 연구는 의무교육에서의 차별해소와 정상적인 장애유아의무교육이 수행될 수 있는 해결방안 마련에 목적이 있다. 이를 위해 첫째, 특수교육법의 관련 조항과 정책에 대한 문제점을 분석하고 둘째, 헌법과 장애인 차별금지 및 권리구제 등에 관한 법률, 교육 관련법 그리고 국제협약 등의 분석을 통해 장애유아의 권리와 차별금지에 대해 논의하고 셋째, 의무교육상 차별해소를 위한 방안과 과제를 제시하고자 한다.
Abstract
In 2007, through the enactment of the 「The New Special Education Law in Korea」, the kindergarten curriculum for Preschooler with Special Needs was prescribed as compulsory education. Discrimination against Preschooler with Special Needs, teachers and parents who are targeted for education continues. The purpose of this study is to resolve the discrimination in compulsory education and to prepare a solution that can be implemented for compulsory education for infants with disabilities. For this, first, we analyze problems related to the provisions and policies of special education law, and second, laws related to the Constitution and the Prohibition of Discrimination and Remedy for Persons with Disabilities, Education Related Law, and International Through the analysis of the agreement, the rights of Preschooler with Special Needs and the prohibition of discrimination will be discussed, and thirdly, measures and tasks for resolving discrimination in compulsory education will be presented.
