본 논문은 시민들이 어떤 민주주의를 구성하는가에 따라 인권과 복지의 경계와 매개의 지점이 달라진다는 관점을 변호한다. 이러한 본 논문의 주된 목적은 인권과 복지의 경계와 상호 제약적 관계의 해명을 요구한다. 따라서 필자는 먼저 경찰국가와 민주국가의 차이를 드러내고(1), 인권 제국주의와 복지 온정주의를 극복하기 위한 출구로서 기본권들 간의 상호 대칭적 제약 관계를 밝힐 것이다.(2) 나아가 필자는 복지 담론에서 기능주의와 평등주의 관점이 민주주의를 시야에서 놓치고 있다는 점을 밝히고(3), 마지막으로 법치국가의 기본 권리로서 인권과 복지가 함께 발전할 수 있는 최선의 통로로 ‘차이에 민감한 민주적 공론장의 최대화’를 제안할 것이다(4).
Abstract
This article advocate the point of view that the spot of boundary and intermediation of human rights and welfare will be decided accordingly how democracy is formed by the people of the nation. The primary purpose of this article is to elucidate the boundary and inter restrictive relation between human rights and welfare. Firstly, this article will show the difference between the police state and the democratic country,(1) then will discuss the inter symmetrical restrictive relationships among the basic rights that can lead overcome the welfare paternalism and human rights imperialism.(2) Moreover, this article will emphasize the fact that the functionalism and egalitarianism in the welfare discuss is losing its focus on democracy.(3) Lastly, this article will suggest 'maximizing the democratic public sphere which is sensitive to the difference' as a path for human rights and welfare system to co-exist and develop together for the basic rights for any constitutional state.(4)
