동양에서 서양바라보기 - 현대 윤리학이론을 중심으로

본 논문의 목적은 다양한 서양의 윤리이론의 요소들이 선진유가(先秦儒家)윤리학 속에 보이고 이들은 하나의 체계 속에서 모순 없이 조화를 이루고 있다는 것을 보이는데 있다. 유가윤리학적 관점에서 현대 서양윤리학계를 바라본다면, 이들의 조화는 가능할 뿐만 아니라 타당한 윤리학설의 수립은 이들을 적절히 종합하여 적재적소에 위치시킬 때 가능하다는 것이다. 선진유가는 현대 서양 당위윤리학의 양대 산맥을 형성하고 있는 공리주의와 칸트의 핵심사상은 도덕형이상학 내지는 메타윤리학적 관점에서 볼 때, 대립할 필요가 없다는 입장을 취하고 이들의 현대적 계승자들에게 화해를 권고하리라 생각된다. 한편, 공맹은 일상적 삶을 살아갈 때, 매사건 공리주의적 선택방식에 따라 옳고 그름을 가릴 것을 권고하지 않는다. 대신에 공맹은 일상적 도덕판단의 기준으로서 서(恕)의 원리--칸트적 공리주의 원리--에 의해 정당화되는 조건부의 일반규칙인 예(禮)를 따를 것을 권고하고 있다. 이 예(禮)에 따라서 도덕적 선택을 하고 실천하는 것을 ‘관습적 도덕활동’의 단계라 명명할 수 있다. 서양 현대 덕윤리는 직각론과 함께 이러한 ‘관습적 도덕활동’을 잘 해명하고 있는 학설들이라 할 수 있다. 이런 의미에서 유가는 덕윤리의 긍정적 측면을 적극 옹호할 것이다. 그러나 공맹은 현대 덕윤리와 달리 칸트나 공리주의에 대해 적대적 태도를 취하지는 않을 것이다. 유가는 예(禮)의 정당성 근거를 칸트적 공리주의 원리인 서(恕)의 원리에서 찾고 있기 때문이다. 사실상, 서(恕)의 원리가 규범윤리학 내지는 현실적 도덕선택방법으로 전환될 때 이 두 측면을 모두 포함하게 된다. 현대 덕윤리가 ‘반성적 도덕활동’의 단계를 받아들일 필요가 있다는 의미에서, 선진유가는 현대 덕윤리와 칸트적 공리주의의 화해를 또한 권고하리라 생각된다. 이는 직각론에 대해서도 마찬가지다. 이와 같이 현대 서양 윤리학설들이 적절한 통합을 이룰 때 진리에 보다 접근하게 되고, 또 동서양 윤리사상의 회통(會通) 역시 활발하게 이루어지리라 생각된다.
Abstract
The aim of this paper is to show that Classical Confucian ethics harmonizes various aspects of Western ethical theories. Furthermore, such a synthesis is good for a construction of universal ethical theory. First of all, Classical Confucian ethics will assert that the core of Kant's ethics and utilitarianism can be harmonized from the Meta-ethical point of view. On the other hand, Classical Confucians do not recommend utilitarian method of moral decision in ordinary life. Rather, they recommend to follow prima-facie duties of li which are justified in Kantian-utilitarian principle of shu. This stage of moral activity can be called 'conventional level of moral activity'. Modern Western virtue ethics and intuitionism are theories which explain this level of moral activity well. In this sense, Confucianism implies positive side of virtue ethics and intuitionism. However, Confucianism, unlike advocators of modern virtue ethics and intuitionism, is not hostile to Kant and utilitarianism. It is because moral justification of virtue and li in Confucianism is based on shu as the Kantian-utilitarian principle. So, Confucianism recommends reconciliation of principle oriented ethics and virtue ethics. This way of Confucian synthesis of various ethical theories is not only desirable for the reconstruction of defensible moral theory, but also can contribute to the meeting of East and West in moral philosophy.
