Abstract
Discovery set forth in the Federal Rules of Civil Procedure authorizes parties to exchange information relating to the case for the fullest possible knowledge of the issues and facts before trial. Discovery in the U.S. federal courts is far broader in scope than in other countries and primarily controlled by the parties, thus civil law countries regarded it as exceptional tools for evidence collecting. Nonetheless, 28 U.S.C. §1782 provides direct access to U.S discovery in international cases, allowing U.S. courts to compel discovery for cases in foreign or international tribunals where the prescribed requisites are satisfied. It was designed to provide equitable and efficacious procedures for foreign tribunals and litigations and to meet the requirements of foreign practice and procedure. Under 28 U.S.C. §1782, the district court of the district in which a person resides or is found may order him to give his testimony or statement or to produce a document or other thing for use in a proceeding in a foreign or international tribunal. It would be the “export of discovery” in that the liberal and party-driven discovery is available for foreign or international proceedings under the provision. The number of discovery requests for use in foreign civil proceedings has been significantly increased for its nature as a powerful tool for obtaining information that could be relevant to the resolution of the dispute. The Korean legal profession has requested the introduction of pre-trial evidence-taking proceedings to adjust the inequality in information relating to the case between parties, presenting the Civil Procedure Amendment Bill in the National Assembly. For its distinctive nature, it would be easily anticipated that U.S. discovery would conflict with the Civil Procedure Act of Korea. The impact of 28 U.S.C. §1782 should be examined with consideration of the evidence rules of Korea.
